How is the state going to send a man or woman to prison for the rest of his or her life, when there was no physical evidence to prove beyond a reasonable doubt that he or she was the one who committed the crime? It's called eye witness testimony, and in the case of Robert L. Jaramillo that is what convicted him in 1993 of a drive by shooting of three, leaving one paralyzed and another deceased. In Roberts case you had one victim and other witnesses who claimed he was the passenger and shooter of the vehicle, which is what the court went based off of but with false eyewitness testimony being responsible for about 75 percent of wrongful convictions, one would have to believe there needed to be more evidence. There was no weapon found,no bullets found, Roberts vehicle was not tested for gun powder residue, nor was he. All that could have helped prove him guilty beyond a reasonable doubt, but instead the court decided to go off eyewitness testimony, a very damaging move. One surviving victim testified in court as to the shooting occurring too quickly and the lighting being poor for him to positively identify Robert as the shooter but the other victim testified as to the shooter being Robert,and in 2009 a miracle occurred. The victim who testified as to Robert being the shooter signed a declaration stating that when he testified in court against Robert, he was untruthful and he did not see Robert as the passenger and shooter of the vehicle but was untruthful due to the death of his cousin and the here say was that it was Robert. In todays system where everyday and innocent man or women is sent to prison, we find ourselves losing faith in our system and when situations like this occurs where it may help a man or women come home, Its important we seek justice and help bring faith back into our system. Even with the declaration,which has been declared new evidence by Paul Zellerbach, its hard to find help in seeking justice for Robert. All we want is for his story to be petitioned and for Riverside County to do the right thing and give Robert the fair trial he never received but so well deserved.
