Petition to overhaul divorce laws and give dads a fighting chance
Current Illinois divorce laws do not provide for fathers rights or the well being of children. I am a single divorced dad who was victimized by the corrupt laws of the State Of Illinois 3 years ago and lost everything I had worked for including my home, my childrens home. I was forced to sign the divorce agreement drawn up by her lawyer, the judge telling me if I don't sign it, he will. At 45 years old, I walked out of court that day with $1500 to my name, a child support order and a pithedic "visitation" schedule with my kids, passing my wifes boyfriend sitting in a chair outside the court room holding their newborn baby. My trusted and beloved wife took everything and gave it all to her boyfriend and married him three months after the divorce was final. As my lawyer explained it, " the courts don't care what happens between the parents, they are only concerned for the children". I saw no concern for my children or my rights as a father to provide for myself or my kids. My story is not unique. Ask any devorced dad and most can tell you a horror story. There is nothing a father can do to protect his kids from having to live with a person such as the man my X-wife is with. A father can not keep what was his own that should belong to his kids but now is divided up between the lawyers, the judge, and the mother. The father has no real recource to take back what was taken from him. A serious issue that effects almost all single divorced fathers in the state is most single divorced dads cannot live at a descent standard of living themselves let alone provide a adequate home, food, clothes and toys for their kids when their kids are with them. Dads need divorce laws suited for today not 1960.
Item 1: There should be financial protection of marital income and assets for a father divorcing the mother when the mother is forfeiting the marriage by having extramarital sex and/or pregnent with another mans child during any point in the marriage.
Item 2: Illinois is considered a "no fault" state. The State Of Illinois needs to recognize fault for the destruction of a marriage and hold accountability for forfeiture of the marriage. There should be recognized and enforceable laws with monetary penalties and restitution to the father and his children who have been victimized by such actions of the mother and her partner(s).
Item 3: A mother should meet a minimum criteria to recieve child support. The minimum criteria being employed ful time.
Item 4: All child support payments should be placed in a trust fund for the children and tied to an ATM card. The mother must keep and provide all reciepts for all purchases made with that ATM card. Cash withdrawls will not be allowed. Fathers would have access to view the account online and moniter were and when purchases are made.
Item 5: The father should be able to financially provide his own home and stable environment for his children and child support should be adjusted or abated to allow the father to do so, especially after the mother remarries.
Item 6. Child support should be temporarelly suspended without having to go to court when the father has a loss or reduction of income.
Item 7: There should be a substancial reduction or abatement of child support when the X-wife remarries.
Sub Item 7a; the remarried X-wife has children from the new marriage.
Sub Item 7b; The remarried X-wife voluntarlly is not employed ful time.
Item 8: Child support calculations should be altered for todays society as woman are making as much or more income than the fathers If the father is laid off or otherwise loses his job, with proof, should have Child Support suspended out side of the court for a set period of time with out penilty or payback. All fathers should not be punished for a few that don't pay their child support.
Item 9: The X-wife should have reduced claim to the marital assets and income when the mother forfeits the mariage by engaging in extramarital sex. She should have no claim to the fathers retirement pensions or investments.
Item 10: The mother should have limited rights of custody when she is introducing these extramarital partners into the childrens lives thus harming the childrens emotions and parental loyalties.
Item 11: The courts must realize that it is not always in the best interests of the children to remain in the custody of the mother.
Item 12: The father must be recognized as an equal parent and able to have a significant voice and be respected in the courts.
We the undersigned belive the divorce laws of the State Of Illinois are corrupt, unjust, and not in the best interests of the children. We believe the divorce laws of the State Of Illinois are in need of a complete and sweeping overhaul.
