Stop the Akaka Bill, let Hawaiians decide their future

Dear friends,

I implore you to put your own signatures on the Petition to Stop the Akaka Bill. If such Bill is passed, the Natives of Hawaii would be subjected to the same treatment that is meted out to Native Americans. The main difference between the two is:

Native Americans inhabited the land of the United States when it was incorporated as the United States. History has shown that the treatment of the Native Americans has been deplorable. They have been forcibly moved off their fertile, native lands, to lands that barely support their lives. e.g. deserts, swamps, and other lands too small to support any entire native tribe. Many of them perished while being herded to the lands deemed appropriate for their use. History has also shown that any time a Native American tribe has found some benefit, by selling products to people not of their lands, they have been either stopped completely, or taxed highly enough to make such dealings nearly unprofitable for them. Anyone who knows the history of even one tribe of Native Americans, knows that the treatment of them has not improved over the years, and has often declined. Any time natural resources have been found on land apportioned to the Native Americans, they have been reclaimed by the United States, thus ensuring that no Native American profits from such natural resource.

Native Hawaiians are not, and have never lived on soil owned, nor conquered by the United States. At this time their lands are being held in Trust by the "Office of Hawaiian Affairs" (OHA) which has never, and is barred from, ceding these lands to anyone other than Native Hawaiians. Hawaii was *occupied* illegally by armed forces of the United States, at a time that the U.S. had a Treaty of Non-Aggression with the Nation of Hawaii. This has never been corrected, and was unlawful.

At the time that Hawaii was voted in as the 50th State of the U.S., the Native hawaiians did not receive the options that the United Nations Charter, Chapter 12, Article 79 states must be offered to any land that has been occupied, at such time that there is any further action taken with that land, and its people. (See: Trust Territories) Those options are: Integration, become a Free Association, or Independence. The vote was to be presented to only those peoples whose land it originally was, but the U.S. allowed anyone to vote, including the persons who benefitted from Hawaii being made a State.

The lands held in Trust by OHA are the lands that had been held in Trust by the Hawaiian Monarchy, which also claimed all the lands of the islands for the people therein. The Monarchy, in turn, allowed the people to live on, farm, fish, and gather from, these lands. (The Native Hawaiians felt that all land was held in truth, by God, and therefore should not be seized nor claimed by individuals.) OHA is currently, with the blessing of the U.S. allowing Hawaiian nationals to use portions of the property held in Trust, only after they have made a lengthy search through the records to prove that they are 50% or more, pure-blooded Hawaiians. Their children, in turn, must prove their own 50% Hawaiian blood all over again, in order to inherit the land their parents held, and so on down through time. That is total nonsense! It merely makes it much more difficult to retain lands held by the Hawaiians.

In 1993, President Clinton signed into law, Public Law 103-150, which apologized for the illegal, armed overthrow of the Hawaiian Government. This should have meant that the Native Hawaiians could again form their own government, and govern themselves. Had that been the case, they could then charge back rent fees from any lands used by the U.S. and private corporations.

Senator Akaka has always pushed for the Natives of Hawaii to have ONLY the freedoms allowed to the Native Americans, rather than have the right to govern themselves. He does not want to see the Hawaiians truly Free. The properties on the islands of Hawaii are sold as "Lease Hold", or "Fee Simple". Lease Hold is a "use" lease for a specified number of years, but the title remains part of the Hawaiian lands held by OHA. Fee Simple gives clear title to the purchaser. Many U.S. citizens (and those from other nations) who purchased land in Hawaii, are afraid that if the Hawaiians gain their Independence, that they would be moved off the land they've purchased. This is not the case, nor intent of the Hawaiian people.

Some people within the U.S. still do not know the history that made Hawaii an Illegal State. Others feel that they benefit from being part of the United States, by garnering welfare, having employment, etc. This also, is not true. Many Hawaiians are employed in menial jobs in Foreign-owned resorts, carrying baggage, driving shuttle busses, waiting on tourists, etc. Other Hawaiians who can find work, are employed at minimum wage or less, and therefore must work more than one job to feed their families. The Hawaiian people did not need Welfare, Medicare, nor Medicaid before the islands were taken over by the U.S. The islands also were *only* attacked at Pearl Harbor because of the U.S. Naval base there. That attack, history has shown, was known in advance, and in fact encouraged by the U.S. military stance in the South-East Pacific. At that time there were many Japanese already living in the islands, and it is highly dubious that Japan would have attacked there, if the U.S. had not had military installations present. The U.S. did NOT protect Hawaii from attack. In fact, if you check, you'll find that the majority of the ships in Pearl Harbor on December 7, 1941, were the older ships due to soon be retired. The more modern, newer ships were given orders taking them away from the harbor just prior to then.
