The Environmental Protection Agency has reticently issued an Interpretive Statement clarifying the intentions of the Clean Water Act, which excludes to make pollution into groundwater illegal. this includes groundwater that could be hydroponically connected to surface water. This not only makes pollution legal, but could allow toxic waste and chemicals leak into our waters, allowing hazardous conditions for anyone who comes in contact with the water.
