People's Rule by Participatory Democracy of San Francisco Bay Area Rapid Transit

Whereas, the San Francisco Bay Area Rapid Transit District has not been responsive to the public, and has repeatedly failed to address systematic organizational problems relative to its abuse of both its elected authority and its use of police powers, most notably exemplified by the Oscar Grant case, other problems encountered with use of powers by San Francisco Bay Area Rapid Transit District, and further, by the examples of the cellular shutoff of August 11, 2011 and the San Francisco Bay Area Rapid Transit Cellular Interruption Policy adopted on December 1, 2011;

The undersigned, submit the following petition, in support of a Participatory Democracy and Governance of the San Francisco Bay Area Rapid Transit that will inform, direct, and aid a core Board of nine supported by a larger Board which shall be established and made up of voluntary working groups from the dynamic model of #OWS General Assemblies, which shall be truly by the people, and for the people.
We the undersigned, submit the following petition, in support of a Participatory Democracy and Governance of the San Francisco Bay Area Rapid Transit that will inform, direct, and aid a core Board of nine supported by a larger Board which shall be established and made up of voluntary working groups from the dynamic model of #OWS General Assemblies, which shall be truly by the people, and for the people:

Whereas, Section 28745 of the Public Utilities Code of the State of California provides that on and after November 29, 1974, the governing body of the San Francisco Bay Area Rapid Transit District shall be a board of directors consisting of nine members elected by election districts;

Whereas, Section 28750 of the Public Utilities Code of the State of California provides that "following each federal decennial census and using the census as a basis, the board shall, by resolution, adjust the boundaries of the election districts so the districts shall be as nearly equal in population as practicable considering the factors specified in Section 28745.6, and whereas, the district boundaries of the San Francisco Bay Area Rapid Transit have recently been adjusted;

Now, therefore, we petition:

A) The #OWS General Assemblies of #OccupySF and #OccupyOakland, and other General Assemblies as may be interested, petitioning them to adopt statements, actions, or resolutions of support for a Participatory Democracy and Governance of the San Francisco Bay Area Rapid Transit that will inform, direct, and aid a core Board of nine supported by a larger Board which shall be established and made up of voluntary working groups from the dynamic model of #OWS General Assemblies, which shall be truly by the people, and for the people.

B) The California State Assembly, petitioning the members of the State Assembly to intervene directly in the governance of the San Francisco Bay Area Rapid Transit by (1) amending the Public Utilities Code and provisions of law that have allowed the San Francisco Bay Area Rapid Transit Board to continue with its current membership and form and (2) establishing a a Participatory Democracy and Governance of the San Francisco Bay Area Rapid Transit that will inform, direct, and aid a core Board of nine supported by a larger Board which shall be established and made up of voluntary working groups from the dynamic model of #OWS General Assemblies, which shall be truly by the people, and for the people.

It is so resolved, by petition of the people.
