tim guerra was convicted in 1996 for 2 counts of promoting child pornography in the first degree for video taping his 17 yr old lover in a sex act. he received 2 15 year sentences and served appx 13 years in prison. after almost 4 years in prison he discovered that he had been lied to about the actual legal age in missouri for his crime. instead of the legal age being 18 as they told him, it was 17. there was in fact, no crime committed. he was convicted knowingly by the state just for being gay in the wrong place at the wrong time! now, the state refuses to allow an appeal of the conviction because he did not discover his innocence until after the time limit for appeal was up. his current appeal in the cole county circuit court was denied by judge richard callahan, even in the face of overwhelming evidence that an error occurred. the states attorney is andrew hassell, p.o. box 899 jefferson city mo. , at the state attroney general's office. he encourages you to write him demanding that mr. guerra's conviction be reversed. judge callahan should also be reprimanded for his failure to follow the law and he should be brought up on misconduct charges befoore the missouri supreme court's disciplinary committee. mr. guerra's attempts have now come to a halt because of a lack of funds for representation. he may be contacted at tim guerra rt 1 box 1431 wheatland, mo. 65779. he personally thanks all those who have signed and will sign his petition as right now, it is his only hope. help him promote signatures by adding this link to gay rights organizations and by sharing the petition with the media demanding that this injustice be rectified!!
