Hollis Crossing Board of Directors - Cease Altering Common Areas without Association Vote

Dear Hollis Crossing Board of Directors:

We, the undersigned owners of Hollis Crossing, formally petition you to immediately cease your planned alterations of the Hollis Crossing Condominium Association common areas, that include, but are not limited to replacing concrete walkways with asphalt ones, as well as removing the trees and end elements to the median strips of the townhouse lots.

These elements are integral to the character of the property and the homes that owners have bought, and part of why this community is frequently cited as one of the most desirable condo associations for individuals and families to buy a home in. Your foolish efforts will degrade this community and decrease property values, while providing none of the ostensible value of the justifications you've expressed to have based your errant decision on.

Moreover, and most importantly, as indicated by the Hollis Crossing Bylaws, the Board is not permitted to alter the common area as originally built, without a two-thirds majority vote of all owners, nor is the Board permitted to perform any alteration that exceeds $5,000, also without a two-thirds vote of the owners.

The Board has failed to seek and secure votes in either capacity, and is now advised that failure to honor the will of the community expressed in this petition may precipitate further and immediate action by the members of the community, including lawsuits against the Board as an entity and the members as individuals, as well as facilitation of a special meeting to vote on the removal of the Board members from elected/appointed positions by the owners.

This is not the first breach of the Bylaws by this Board, as it relates to the alteration of common area property, given that the Board previously unnecessarily removed more than 20 trees from the property, expending in excess of $30,000 in capital, after frivolously raising condo fees to support this move - without seeking a two-thirds vote of the Association in either similar capacity as required.
