Change CPS Laws and Help Save Americas Families



Many families in the United States - sometimes adoptive as well as natural - have been needlessly torn apart. Parents - especially those who are less affluent and unable to fight back effectively - are guilty until proven innocent. 
There are federal incentives to get kids into foster care and then incentives to get them adopted. Does it make sense to have incentives for one child "placement" over another? When there are quotas of the number of supposedly "abused" kids that need to be met in order to obtain federal funding, does the definition of "abuse" start encompassing things that are not really serious enough to warrant removing a child from his family and everyone he knows?
At what point are citizens individual rights being violated by child protective services? Sometimes when parents just need a little help, it's more compassionate to help, than to criticize.
Many entities profit when a child is placed into foster care (psychologists, lawyers, social workers and more). Because of funding, there is an incentive for CPS to "place" kids with foster care providers - rather than relatives who are not foster care providers - while they decide whether a parent is fit. 
Many foster care providers today are what's called "fost-adopts" - "fost-adopts" are people whose goal is to get a child. Ordinary citizens may not realize there are time limitations and they may not know that there are bonuses to get children adopted.

When the professionals they trust tell them they cannot file for custody while a case is being heard in Juvenile court, how many parents, grandparents and other relatives will figure out that they must ask for concurrent jurisdiction to file for custody, adoption or other things in District Court while the case is being heard in Juvenile court? Parents and other relatives do not know how to navigate the system and all it%u2019s pitfalls. And they must navigate the pitfalls while in a state of shock, with no idea where to obtain real help and worried their children will be lost to them forever.
We the undersigned do hereby propose the following laws concerning our children, America's families, and parents, to be changed and ammended.  
These law changes need to be addressed based on the following facts:

**There are quotas of the number of supposably abused children that need to be in order to obtain federal funding.  Too many of these quotas being met dishonestly, just for the almighty dollar despite what it may do to millions of families.  **

The following is a list of proposed laws that desperately need your attention and time.  Please take the time to go over these important isues that affect our childrens lives, and the families who love them.  
Parents all over america are being denied their right to the following law that was also passed in 22 other states.  
  • The 1997 Minnesota Designated Parent Law is a law where parents can list a responsible adult who has agreed to care for your child(ren) for up to one year in case of an emergency - this includes legal emergencies and situations. If families complete this form in advance, their children would be legally protected to live with designated family members during a child abuse investigation, rather than in foster care.
There are so many issues that could be resolved with even  just a few of our 21 laws proposals, if not all of them,  being put into effect by you as our leaders.  

Child Protective Services (proposed changes)


(1)CPS's budget should cover all foster fees providing an incentive to get the child out of foster placement

(2)Federal funding should not be based on total number of accusations made
(3)Federal funding should not be based on total number of adoptions made

(4)Better alternatives for foster care - such as having daily CPS visits in your home or having a CPS worker live with the family

(5)Guardian ad litem (GAL) should be independent of CPS. It should be illegal for a GAL to strategize in closed, private meetings with CPS

(6)Foster providers who have placement cannot adopt children, unless there are no family members available or parents willingly give up their parental rights.  Knowing they can adopt causes the foster providers to be unobjective and provides no motivation to work towards family reunification
(7)Parents can schedule doctor appointments for their child

(8)Parents have the right to change foster placement if the care is hazardous or unhealthy for their child
(9)Parents have the right to decide if the foster providers may place their child in day care

(10)If parental rights are terminated, adoption goes first to other family members, even if Social services have to search for other family members that may live out of state. 
(11)Request for Appeal to deny County registry of maltreatment by Social Services should allow for a longer window of opportunity, aside from the current fourteen days period

(12)Appeal Hearing to refute County registry of maltreatment by Social Services should be before a jury of peers

(13)Parents determine placement - child should go to other family members

(14)Daily visitation required and foster home must be flexible with parent's working schedules

(15)Cannot remove children with little or no evidence

(16)Cannot place both parents on the petition if only one is suspected
No Blackmailing techniques (i.e. If you'll just admit, you'll get your baby back)

(17)CPS agents, Foster Care Providers, Guardian Ad Litem, and Social Workers Required to complete psych testing to rule out any who were abused in their own personal lives.

(18)Reunification is ALWAYS the top goal - no time limit for quantifying this

(19)Parental rights cannot be terminated unless found guilty at criminal trial

(20)CPS case must be dismissed and children returned if acquitted at criminal trial

(21)Parent's names removed from Child Abuse Registrar when case is dismissed, unsubstantiated or acquitted.
