
On Wednesday 2nd of November at 7:55pm Emma Foster, aged 19, Jonathan Grey, aged 23, Stuart Johnston, aged 19
left our home in Banff Scotland heading to Aberdeen to see the newly released Harry Potter film.
They never made it. Because at 8:20pm John Wells decided to overtake a 4X4 he was tailgaiting.
He turned the wheel and hit the gaspedal and put himself into the oncoming lane of our daughter, her fiance
and their best friend. That was the moment all our lives ended and changed forever.
John Wells, called his cousin on his mobile phone and told him that he had been involved in a car crash, he was standing on the opposite side of the road from the crash,
not once did he go over to see who was in the car and if there was anything he could do.
Yes, he phoned the emergency services, but, when the paramedics arrived, he walked up to them
complaining of a broken collar bone and DEMANDED he be seen to, in our eyes, he didn't call the emergency services for those injured and dying
in the car, he called them for himself.
Stuarts car was wrecked, it had been crushed to half its normal size, the steering wheel
crushed Stuarts chest and burst his heart, he lived for less than a minute after, he looked
up at Jonathan, closed his eyes and he was gone.
Jonathan's legs were trapped, the engine of the car had been pushed forward so far inside the car he couldn't move,
he was slipping in and out of conciousness, but all he cared about was his beloved Emma who was trapped in the back footwell.
It took around an hour to cut Jonathan free from the wreckage, he was taken to Aberdeen Royal Infirmary by air ambulance,
it took another half hour before they got Emma out and the only way they could do that was by removing the back seat and
dragging her through the boot of the car.
We arrived at the crash scene at around 10:20pm and they were STILL trying to cut Stuart's body out of the car.
(I must tell you that we HAD to pass the crash scene as it is the only way to get to Aberdeen)
We arrived at the hospital and Emma and Jonathan were undergoing surgery and we waited, hoping and praying that they would both pull
through ........ they never did and we never saw Jonathan or Stuart again.
Emma went through a 5 1/2 hour operation ....... they brought her to the intensive care unit, we went
in to her, she had a tube coming from her mouth that was filling up with nothing
but blood, the surgeon told us that her lungs had been crushed and the blood we saw
was what was filling up her lungs, as fast as they were pumping it out, they just kept filling up again.
We asked him what her injuries were, he didn't want to tell us but we insisted, we wanted to know,
he told us that she had a fractured skull, broken collar bone, broken arm, broken ribs and sternum, broken hip and femur, the broken ribs and sternum had in turn crushed
her lungs, heart, pancreas, liver and spleen, she stood no chance of surviving, the life support machine was the only thing
keeping her alive.
We then asked how could we make the decision as to when to turn off the life support, they told us that we didn't
have that choice, Emma was so weak, she would just slip away, three minutes later .. she was gone too.
I cannot comment on Stuart and Jonathan's injuries, but THIS is what John Wells did and THIS is what he got away with,
by driving dangerously, he killed three wonderful young people without a thought about his driving and without
a thought of what he did to three families.
The trial was set for December 2006, witnesses called, and it came out (but was not read in court) that John Wells was traveling
at a speed of between 73mph and 82mph in a 60mph zone, Stuart was driving at between 43mph & 48mph, but,
behind closed doors, the defence and the prosecution came to an agreement that they were both driving at 60mph,
because there were no skid marks.
After the evidence had been heard, the judge ordered that the jury should not take into account emotions of
the victims families, and if there were any doubts at all, they should return a verdict of "careless driving" and not
dangerous driving, which John Wells was charged with.
After two hours, the jury came back and delivered their verdict, "not proven", this meant that John Wells had
basically got away with murder,he would have the lesser punishment.
He recieved a £2,000 fine and a three year driving ban, in December 2009, he can re-apply for his licence, a licence to kill.

We would like the judicial system changed, where the judges discretion clause altered and the sentence
should fit the crime .......... no lesser charges . and a car should be classed as a lethal weapon.
