
In recent years NOPD officers have been charged, convicted, and/or plead guilty in cases of abuse and criminal misconduct; including unprovoked arrests, beatings, shootings, killings, and conspiracy to cover up any wrong doing on their parts.
This is a conspiracy case around the nonfatal shooting of Officer Kevin Thomas where Lt Robert Italiano and other NOPD officers including Kevin Thomas himself, New Orleans District Attorney's office and some Jefferson Parish police blatantly and illegally conspired to convict Jamil Joyner by planting evidence, falsifying/rewriting official police reports and manufacturing testimonies that completely contradict physical evidence to purposefully mislead the jury. Falsifying/Rewriting Reports: After the initial police report was completely recorded by the Detective with what he observed on the scene in 2005, it was amended adding new information some months later. In the amended portion Officer John Mitchell (officers on the scene and Officer Kevin Thomas%u2019 partner) gave his account of what happened but didn%u2019t specifically identify or implicate any particular person. Officer Thomas was quoted in the same police report saying he couldn%u2019t identify anybody because he didn%u2019t remember being shot (Click here to review in Police Report). The only person who identified Jamil Joyner as the person who shot Officer Thomas in that report is Lt Robert Italiano claiming Officer Mitchell told him that. Italiano was not on the scene and was recently indicted for falsifying/rewriting reports and misleading investigations into the death of Henry Glover. Click here to view story on indictment.
Planting Evidence: None of the physical evidence supports Jamil Joyner%u2019s guilt. Five fingerprints were lifted from the gun that was alleged to be the one used to shoot Officer Thomas (a .45 caliber) and none of the prints matched Jamil Joyner or any of the other men with him. The gun was falsely reported to the media as being in Joyner%u2019s waist/belt at the time of his arrest but Joyner said he has had no idea where that gun came from and alleges it was planted by police. The trace on that weapon returned the following: %u201CTraced to a Federal Fire Arms Licensee to whom no record exist.%u201D (Click here to review trace report). Even further, there is no concrete evidence that supports the .45 caliber as the gun that shot Officer Thomas. When a request was made to West Jefferson Hospital for bullets recovered from Officer Thomas%u2019 wound, NOPD was advised that no bullet was recovered. (Click here to review in Police Report).
If Joyner was standing two feet to the left of Officer Thomas, as the officer testified, considering Joyner%u2019s arm reach and the velocity of a .45 caliber, the bullet could not enter exit on the same side and Officer Thomas would not have survived such a close ranged 45 caliber gunshot wound.
Manufactured Testimony
Officer Mitchell%u2019s Testimony: Sye Carter was charged with and went to trial for attempted murder of Officer Thomas in 2008. Officer Mitchell was the prosecutions star witness and he identified Sye Carter as the one who shot Officer Thomas. The prosecution loss that case due to lack of physical evidence to support it. Officer Mitchell later submitted the same testimony at Jamil Joyner%u2019s trial, testifying that Sye Carter the shooter. He also testified that he didn't see Joyner with a gun and said that is what he told the detectives who came to investigate the scene of the crime. (Click here to read in transcript).
But the prosecution used Lt Robert Italiano%u2019s word and hearsay testimony; claiming Officer Mitchell told him Jamil Joyner was the shooter, to impeach Officer Mitchell%u2019s sworn testimony and then painted a picture of Officer Mitchell as being unstable.
Officer Kevin Thomas%u2019 Testimony: Officer Thomas testimony in court differed critically from what he reported to different media sources. For example, in 2010 he testified at the trial of Jamil Joyner that he was shot in the front of the head and the bullet came out by his ear, but he told CNN in an interview in 2005 that he was shot by his ear and it came out the front. The reason this is
critical is because of where the officer said Joyner was standing at the time he was shot: facing him about two feet to his left. Its impossible for a bullet to travel through his ear on the left side and out the left side of his forehead from that position.
He also said Joyner shot him while he was searching the person next to him but told CNN in that same interview that he was shot by the person he was searching which, according to his testimonial account of the lineup, would have been Sye Carter (Click here to review testimony in court transcript). You%u2019ll also notice that during the entire short CNN interview, he didn't name, identify or physically describe anybody as the person who shot him.
It is of importance to note that Officer Thomas%u2019 disciplinary record with the New Orleans Police Department includes things like suspension for unprovoked attack on a fellow officer and striking him in the jaw, neglect of duty, insubordination, violation of department rules, lack of truthfulness, mishandling of evidence and mishandling of injured suspects.
Detective Fred Austin recorded in the police report that Officer Thomas said in 2005 that he couldn%u2019t identify any of the perpetrators because he didn%u2019t remember being shot (Click here to see note in police report). But in 2010 he participated in the conspiracy to convict Joyner by testifying that Joyner was the man who shot him. There is much, much more research that uncovered the lies and conspiracy of NOPD in the case against Jamil Joyner.

Prior to Katrina Joyner had no criminal record and he was a brilliant young businessman who had his businesses legally registered with the State of Louisiana. He lived an exemplary life, actualizing his potential and had no reason or desire to shoot anybody. He proclaims his innocence and deserves his life back. He has two small children (ages 8 and 6) and faces a minimum of 20 - 50 years in prison for a crime that the evidence proves he didn't commit.

Due to this injustice, Joyner lost everything and faces a 20 - 50 sentence. We desperately need at least 3000 signatures to push for a retrial and a Federal Investigation into the misconduct of the New Orleans Police Department and New Orleans District Attorney Office concerning this case, as they've done in the cases of many others who were grossly mishandled during the Hurricane Katrina aftermath.
