Accidents happen sometimes pets get out into the roadways and they are no match for vehicles regardless of the speed of the vehicle.
When an animal is struck by a vehicle that flees the scene the law seems to be a bit muddy. It is considered a motor vehicle accident and the driver can be charged with leaving the scene of an accident (in Springfield, Mo) according the the compassionate officer that responded when our dog MJ was plowed over by a woman who was going so fast down our street that she didn't see my husband in the middle of the road trying to get her attention so she wouldn't hit her. However he also told us that the case would not likely get any attention.
Solution:
Any person driving a motor vehicle that strikes an animal must stay at the scene contact the authorities to report the incident and wait for them to arrive to assist the animal. (Accidents happen)
Any person driving a motor vehicle that strikes an animal who then leaves the scene shall be charged with 1. Leaving the scene of an accident
And/or
2. Wreckless endangerment (leaving an injured animal is both reckless and dangerous)
Any person convicted of either of the above charges shall pay restitution for medical Bill's and fines as assessed by the city/county in which the incident occured.
