PROVIDENCE, R.I. (WPRI) - The Rhode Island Supreme Court has agreed to hear a second appeal brought by a convicted killer, who is serving a life sentence for a 1996 murder he says he didn't commit.

Derick Hazard insists he's innocent and wants a new trial. Hazard, who is now 36, was locked up 10 years ago for killing David Andrews.

A jury found Hazard guilty in 1998 of fatally shooting Andrews in Providence, and has been held at the Adult Correctional Institutions since. Andrews who is now deceased has recanted his story several times on the witness stand and to various individuals.

Hazard was granted his first appeal after stating his lawyer failed to investigate that he was not in Rhode Island the night of the crime. Hazard maintains he was on the way to Ohio at the time of the slaying. He says he was driving in his car when he was stopped by police in New Jersey, 12 hours before the murder.

 Hazard is up for parole in 2018.
