DOJ Says It Can Demand the Emails of Anyone in the World: Fight Back!

The United States government says it has the right to demand the private emails of anyone in the world, so long as the email provider is headquartered within U.S. borders.

The DOJ is currently in a court battle with Microsoft, which says the U.S. government is overstepping its boundaries by demanding (via court order) that Microsoft turn over emails held on a Hotmail server in Ireland.

"We would go crazy if China did this to us," counsel for Microsoft told the court.

If the DOJ wins its case, it could set a dangerous precedent and allow the government to retrieve any information it desires from the cloud, further eroding our right to privacy. Apple, the government of Ireland, NPR, the Guardian, and Fox News have all filed amicus briefs with the court, arguing the government is overstepping.

The DOJ says emails should be treated as "business records," and thus a search warrant should be sufficient for the government to access them.
