Give me the right to be with my children

Give me not only the right to be with and bring up my children, but give my children the right to have their father with them and involved in their daily lives.
I am a fifty three year old Male South African,and came across your site while surfing the internet.

The reason why I am appealing to all you people out there to sign this petition is for basically the following.In 1999 I was divorced from my wife who basically left me for a Canadian man who she is now married to.
About 6 months after she went to Canada she contacted me and asked me to bring the kids to Canada then aged three years and eight years old respectively to visit her.
After dicussing the matter and knowing that my children really missed her a lot,I decided to take the children to visit her in Vancouver.
We arrived in Vancouver on the 15th March 2000,and stayed in the basement suite of my ex wifes homefor the duration of the time we were meant to be there.
When the time drew near for us to return to South Africa,the children became very upset at the prospect of once again being parted from there mother,and also there mother being parted from them .
It was a forgone conclusion that I would not leave without them and eventually I decided that if I could somehow find a way to get permanent residence that I would stay as I really liked Canada a lot and this would also be the perfect solution as the kids would have the benefit of being near and with both sets of parents on a permanent basis.

I dicussed this matter with my ex wife and we decided to put the kids into school,and then I would apply for permanent residence on humanatarian and compassionate ground.

After applying for permanent residence I lived in Canada for about 20 months during which I was with my children on a daily basis taking them and picking them up from school,doing their washing cooking etc,and just doing what ever it takes to look after young children.

An immigration hearing was granted to me in about October 2001,which was just after the terror attacks in New York on the Trade centres.

Unfortunately my application for permanent residence was denied without any reason and I was told that I should reapply from my country of origin as due to the terror attacks that that there were new emergency laws that now applied.

At the time I was issued a document of voluntary departure that stated that if I left voluntarily by a specific date that I would not be denied future entry into Canada,and if I did not leave by the specified date that a warrant of arrest would be issued.

After dicussing the matter it was decided that due to the fact that the kids were settled and happy in Canada that I would leave the kids in Canada and come back to South Africa and find a way of getting back as soon as possible..

Besides my own grief,the kids took it really badly when I left, as from the time they were both born the kids and I had an extremely good and close relationship.

Since leaving Canada which has been two years, the kids have now got permanent residence.I have kept contact with them almost on a daily basis iether via the internet MSN Messenger or by telephone.The children can not wait for me to get back and basically it is eating me up being parted from them for so long.

Twice this year I have applied for a visitors visa to go and see them and was denied a visa on the grounds that I do not have enough ties in South Africa and the Canadian authoruties here believe that I would not return.

I have since written to the Minister of immigration ins offices in Ottawa and all they say that they do not see any reason why they willl not let me into Canada to see or be with my kids unless they feel that I might abscond once in Canada.

The whole point of the matter is that in the meantime they are keeping me away from my children,and I feel that by doing so they are denying me and my lkids our basic human rights.besides being extremely petty.

I have the support of both my ex wife and her present husband in this matter and also her husbands family in this matter,and also the teaching staff at both of my childrens school in Canada
I really feel that after living in Canada for a period of nearly two years and then being told that I should leave that my children and I have been done a great injustice and our basic human rights have been breached by parting us the way that they did.
I feel that if I could get enough signatures on this petition from all you people out there then I do still stand a chance of rectifying this situation
