I recently read an article regarding the case of Julio Morales who had previously been convicted of raping a sleeping woman by pretending to be her boyfriend and I'm APPALLED at the decision of the Los Angeles 2nd Court Of Appeal to overturn the conviction! The court claimed the following:
"A man enters the dark bedroom of an unmarried woman after seeing her boyfriend leave late at night, and has sexual intercourse with the woman while pretending to be the boyfriend," the Los Angeles-based 2nd District Court of Appeals said in Wednesday's ruling. "Has the man committed rape? Because of historical anomalies in the law and the statutory definition of rape, the answer is no, even though, if the woman had been married and the man had impersonated her husband, the answer would be yes."
Judge Thomas L. Willhite Jr. wrote this in the court's decision. So, this basically means that simply because a woman isn't married, she isn't protected against a filthy, vile rapist! The neanderthal laws which made this grave miscarriage of justice possible MUST be changed and it's the duty of the Los Angeles 2nd Court Of Appeal to reinstate the conviction of Julio Morales and do right by his victim! It's time to show an example by letting other rapists know this type of behavior will NOT be tolerated any longer!
