Release Christopher Thrasher

 TO WHOM IT MAY CONCERN:

This Petition is put forth for granting a New Trial, Executive Clemency or commuting the Life Without Parole sentence of Christopher Thrasher. This petition is based on these facts.

A. Grounds of newly discovered evidence.

1. Constitutional violations have become evident during trial.

2. Ineffective counsel denying Christopher Thrasher his 6^th Amendment constitutional right which guarantees effective assistance of counsel. Evidence brought to light of drug addiction of defense counsel during trial.

3. Motion for Change of venue denied despite 54 out of 60 polled jurors had knowledge about the case and that it was nerve racking on TV and radio.

4. The state witness that testified all 3 boys were in the same gang, was not a gang expert and we have acquired testimony from a gang expert in a report disputing this was gang involved . Also, testimony that one of the defendants was not in a gang. Thus, eliminating the motive, plan and scheme given by the district attorney of the involvement of Christopher Thrasher as their gang leader.

B. CHRISTOPHER had no criminal history, prior to the charge for which was convicted, and at the age of 16 tried as an adult.

1. There was no evidence of an extensive record, no evidence of mental maturity and no evidence that the community would be better served by transferring Christopher to be tried as an adult.

2. The juvenile judge’s transfer order stated that the only reason for transfer to adult status was the seriousness of the offense. Even though there was IRREFUTABLE EVIDENCE he was not present when the crimes were committed.

C. Christopher was an innocent victim of circumstances beyond his control.

1. The 2 defendants that committed this crime , informed Christopher of their actions after the fact. He was left at another location passed out from alcohol when the actual murders transpired. He was scared and had clouded judgment from alcohol, to process the horrifying details (told to him by the other defendants) that his best friend had been murdered.

D. Christopher has proven he is not a threat to society and anxious to begin a life.

1. His prison record speaks for itself, that he is working to keep a clean record and free of trouble.

2. He has educated himself by reading incessantly and becoming informed in all areas of life and current events.

3. He has a good family base that is and will be standing behind him to help him adjust and become the productive citizen he desires.

4. He will have a residence and help with his material needs until he can manage financially. He has several offers of employment waiting on his arrival.

5. He is going to attend counseling to help him adjust to life outside the walls of prison.

6. He is taking distance classes to continue his High School Education, to receive his diploma. He then wants to continue with college courses.

Christopher Thrasher deserves a chance to have a life, after spending the past 14 years in prison. He was 16 and is now 30 years old, continuously working to be ready for the day he can come home to his family.
