Sentence Review and Modification

Statement of Purpose: To delete the prohibitation on a defendant seeking review by the sentencing court of a sentence in excess of three years unless the prosecuter agrees to such review. Under current law, defendants sentenced to less than three years may make unlimited request for modification.  We want a bill that allows all non-violent defendants, regardless of their sentence lenght, to make an initial request for modification without first getting the state's attorney's approval.
