
The first step of a backroom deal by Nestle Corporation to bottle Oregon’s water and sell it off as a private commodity has been approved by the Oregon Water Resources Department:
It is called the Preliminary Determination Proposing Approval of Additional Points of Diversion in the matter of the Transfer Application T-11249, Hood River County.
We only have 30 days to respond in protest under OAR 690-380-4030:
This is public water, for all the nature and people of Oregon, not to be “diverted” for a private corporation’s profit off of Blue Gold!!!

*******Notice of Preliminary Determination for Water Right Transfer T-11249********
T-11249 filed by Oregon Department of Fish & Wildlife, 3406 Cherry Ave NE, Salem, Oregon 97303, proposes a point of diversion change under Certificate 24625. The right allws the use of 9.5 cubic feel per second from Little Herman Creek in Sec. 7, T 2 N, R 8 E, W. M. for operation of a fish hatchery in Sec. 8. The applicant (ed. Nestle Corporation’s hired entity) proposes additional points of diversion in Sec. 7 and 8. The Water Resources Department proposes to approve the transfer, based on the requirements of ORS Chapter 540 and OAR 690-380-5000.
Pursuant to OAR 690-380-4030-, any person may file, jointly or severally, with the Department a protest or standing statement within 30 days after the date of final publication of notice in the Deaprtment’s weekly notice. A protest form and additional information on filing protests may be obtained by calling 503-986-0883. If no protests are filed, the Department will issue a final order consistent with the preliminary determination.
We the undersigned respectfully protest the recent approval of the Preliminary Determination Proposing Approval of Additional PoinTs of Diversion in the Matter of the Transfer Application T-11249, Hood River County, Oregon. The transfer request was published May 31, 2011 and we opposed it and T-11109 and will continue to do so!
The transfer requests were made by Nestle's entity as part of their agenda to bottle up Oregon's water which belongs to the public and our regional ecosystem, and sell it off for corporate profit.
Both applications are steps towards permitting a proposed Nestle Water Bottling Plant in Cascade Locks to divert water from Little Herman Creek and other points. The spring and creek water Nestle plans to bottle and sell is currently used to raise endangered salmon and protect the general health of Oregon's wildlife and people: the water belongs to Oregon's environment and constituents, not to corporations who will profit and move on. The few jobs they promise are no protection against this loss. The approval process has moved forward in part because wildlife, the watershed, and general public who depend on this habitat are not corporate entities with "personhood' or a legal voice to "claim" how this infringes upon what they "own", thus bring a claim against what Nestle proposes to do. The issues of habitat and public protection fall to the Oregon Department of Fish & Wildlife, and the respective departments related to Fish and Water management with their differing systems and interests. Yet we know that the overall wellbeing of all Oregonians, including our habitat protection and quality of life, rests upon public conscience and planned protection for future generations. We cannot in good conscience accept Nestle's attempt to privatize our valuable public resource and sell it off as "their product".
We appreciate your consideration of our objections and thank you for listening as we voice formal objection to this approval, the first of many steps to permitting Nestle, a multinational corporation, to exploit our regional resources, export our spring and aquifer water, and deplete our local environment while privatizing and profitting on the back of the public. We all depend on access to this vital natural resource and we will continue to oppose their agenda.
