Repeal ordinance 20:20-1 d.,h.,i.

  • por: Occupy Newark
  • destinatário: City of Newark, New Jersey Municiple Goverment

We the People of Newark believe that Ordinance 20:20-1 is in violation of our first amendment right to peacefully assemble.

d. Camping: No person in a park shall set up tents, shacks or any other temporary shelter for the purpose of overnight camping, nor shall any person leave in a park after closing hours any moveable structure or special vehicle to be used or that could be used for such purpose, such as house trailer, camp trailer or the like.

We the people of Newark believe that this ordinance denies the citizens the right to utilize a public space to practice their first amendment right. We demand that this constitutional right be upheld by the appeal of ordinance 20:20 d., h., i.. We are nonviolently supporting the local community by providing shelter, food and companionship to a struggling community. We have spent the last few months listening to the sorrows of our people. Attempting to find solutions to the abhor realities we have come to recognize of our community. The excessive unemployment, the over taxation, the reduction of social programs and a shattered population that deserves hope.
We recognize the value of solidarity and request the removal of the ordinance to prevent the municipal government from squandering any more time on this issue. The community of Newark request accountability, a responsive elected body that will listen to our grievances and help us help our community.

h. Fires: No person shall build or attempt to build a fire.
During these cold winter months to reduce the need for heaters we would like to utilize safe controlled fires as a form of heating up the occupants and local community. We recognize campfires are in no way a threat to the community but a tool to prevent more illness and cold inflicted issues.

i. No person shall fail to produce and exhibit any permit from the Director of Neighborhood and Recreational Services he/she claims to have upon request of any authorization person who desires to inspect same for the purpose of enforcing compliance with any ordinance or rule.

We the people of Newark recognize the public space to have been created for public assembly and do not acknowledge the request to present documentation to utilize our public space as a civic forum and home for our community,
We recognize these regulations to have been impeding to the people's rights. We demand them to be repealed.

We the people urge the city council to recognize that Newark is a model in the occupy movement when councils around the nation have denied the community cooperative behaviors we stand as an example to the world. Occupy Newark has spent the last few months learning about our community we have supported our community with shelter because everyone is welcome to join our community. We have fed every hungry mouth that has found us and clothed every needing individual. We have loved our people and listened to their grievances. These winter months have been difficult the proportion of unemployment challenge the survival of our community. So let us together place Newark on the map for social mobility. Repeal this invasion and stand in solidarity with the people of Newark.
