Tell FDA: End the sale of flavored e-cigarettes that are hooking kids amid COVID-19

E-cigarettes pose a double threat to America's kids. Not only are flavored e-cigarettes addicting a new generation to nicotine, health experts now warn smoking and vaping can worsen COVID-19.

To protect our kids, the FDA must clear the market of flavored e-cigarettes, which have driven this youth addiction crisis. Amid COVID-19, this is the worst time to allow a predatory industry to hook kids on these dangerous products.

The tobacco industry peddles nicotine-loaded e-cigarettes in thousands of kid-friendly flavors, from mango and mint to gummy worm and cotton candy – hooking over 5.3 million kids.

E-cigarette companies faced a deadline of May 12, 2020, to apply to the FDA to keep their products on the market. But that deadline was pushed back to September 9th.

Our message to FDA: Side with kids over the tobacco industry by rejecting further delays and clearing the market of flavored e-cigarettes that addict kids.

To the U.S. Food and Drug Administration:


We, the undersigned, urge you to clear the market of flavored e-cigarettes that have hooked millions of kids – and to reject further delays in the September 9, 2020, deadline for e-cigarette companies to apply to keep their products on the market.


E-cigarettes pose a double threat to the health of America's kids. Not only are flavored e-cigarettes addicting a new generation to nicotine, health experts are now warning that smoking and vaping can worsen COVID-19.


The tobacco industry is peddling nicotine-loaded, highly-addictive e-cigarettes in thousands of kid-friendly flavors, from mango and mint to gummy worm and cotton candy. These products have hooked more than 5.3 million U.S. kids.


To protect our kids, the FDA must clear the market of flavored e-cigarettes, which have driven this youth addiction crisis. With the added threat of COVID-19, this is absolutely the worst time to allow a predatory industry to continue hooking kids on these dangerous products.


No more excuses: Clear the market of all flavored e-cigarettes. The evidence is clear: flavored e-cigarettes have driven this youth addiction epidemic. Most youth e-cigarette users use flavored products and say they vape because of the flavors. In contrast, there is no credible evidence that flavored e-cigarettes help smokers quit. The FDA must side with kids over the tobacco industry and use its power to remove flavored e-cigarettes that are addicting our kids.


No more delays: Enforce the 9/9 deadline. The youth e-cigarette crisis is the direct result of the FDA's repeated delays in effectively regulating e-cigarettes. The FDA first said it planned to regulate e-cigarettes way back in 2011, but didn't do so until 2016 and even then it delayed the deadline for e-cigarette companies to apply to keep their products on the market. These delays allowed Juul and other companies to hook millions of kids with sweet flavors and massive doses of nicotine. We cannot afford more delays that allow these companies to addict even more kids.


No secret process: Disclose which products have filed applications to stay on the market, the outcomes of these applications and the reasons for the FDA's decisions. The public deserves to know that the FDA is making decisions that protect our nation's kids and health, not the special interests of tobacco and e-cigarette companies. These decisions are too important to be made in secret.
