Music Consumers Bill of Rights


A complete licensing agreement shall accompany the sale of any personal music usage license regardless of the format selected or its method of delivery.
Any changes to the personal music usage licensing agreement will not be retroactive for previously licensed music which included its own unique licensing agreement at the time of sale.  The new ratified personal music usage license agreement will be valid for the current license sale only.
Any personal music usage license sold along with a tangible music carrier is fully transferable and may resold along with the tangible music carrier at any time by the licensee.  By agreeing to sell the personal music usage license along with tangible music carrier the previous licensee forfeits all usage rights he/she held under the initial personal music usage license agreement.  The previous licensee agrees at the time of sale to erase and destroy all forms of fair use copies regardless of the format or the technology used to create any fair use copies.
All fair use principles will be clearly defined in the personal music usage licensing agreement which must be included by the grantor of any personal music usage license at the time of sale.
The first minimum fair use standard shall permit the licensee the right to create an analog or digital music copy from the tangible music carrier for his/her personal use on multiple playback devices and systems.  An example of such usage would be but not limited to the licensee creating a digital music file from the tangible music carrier to be stored on a computer system,  a home music server, a portable digital audio player and the digital audio player installed in his/her vehicles while retaining the personal music usage license.  
The second fair use minimum standard shall permit the licensee the right to change the format of any licensed down loaded digital music file to any analog or digital compatible format for use on any playback device or system for his/her personal use.
The music license grantor agrees to permit the licensee use of all visual images and text that are distributed with the tangible music carrier in conjunction with the creation and use of any fair use digital music file while retaining the personal music usage license.
 A guarantee for the replacement of the any music delivery system that may become comprised or destroy due to equipment failure, physical wear, accidental damage or manufacturing defect such as but not limited to digital data corruption and tangible media failure.   The music license grantor shall give the licensee the opportunity to replace the said music delivery system at the actual cost of conveyance.  The term actual cost of conveyance will be defined as: 1. the actual cost of bandwidth to reconvey the loss of a down loaded digital audio file. 2. the actual cost to physically manufacture  the tangible  media along with the actual associated cost of its physical delivery to licensee.  This clause shall protect licensee since the personal music usage license has already been purchased.
