Dear Honorable San Jose Mayor and Council,
For the safety and the quiet enjoyment of our residents and our schools, we the undersigned respectfully request the removal of the following section from the San Jose Drive-Through policy (Policy 6-10) in relation to the set back requirements adjacent to residential properties: "Self-service car washes which are proposed in conjunction with existing gasoline service stations may be exempted from this locational criterion provided the traffic criteria in I above are satisfied."

Background:
Our group, Save Our Neighborhoods, is asking for your help to protect our neighborhood and the children going to both Farnham and Saint Frances Cabrini Elementary schools on Woodard Road by signing our petition.
After almost a year-long battle by neighborhood residents, on Jan. 23, 2018, the San Jose City Council voted down a Conditional Use Permit request by Andary Enterprises, Inc. to add an automated carwash at the Andoil Gas Station on the corner of S. Bascom Ave. and Woodard Road in San Jose.
This proposed carwash would have been less than 25 feet from 16 four-plexes, and 160 feet from an elementary school, running 7 days a week, and 14 hours a day. The carwash exit would have been in the direct path of children, pedestrians, and cars going to and from both of the elementary schools on Woodard Road.
An outdated loophole-exemption to the San Jose Drive Trough Policy, written back in the 1970s, allowed Andary Enterprises, Inc., to bypass the normally required 200 feet from residential areas like all other Drive Through Uses. We want the City to eliminate the loophole that allows carwashes an exemption, and require carwashes to be 200 feet away from residential areas, and adjacent businesses.
This petition is asking the San Jose Mayor and Council to leave the setback at 200 or more feet from residential areas because if this exemption remains, Andary Enterprises, Inc. can re-apply for an automated carwash on this site again. It is our understanding that they are already drawing up a new design for this site, and will be re-submitting the carwash using this loophole-exemption.
