Petition to Remove Negligent Homicide from the inditement of a fatal car accident with no illicet su


This last year has been the worse year of my life. My daughter and her husband suggest that I write to you. I was involved in a major car accident that was my fault. I was not drinking, or using a cell phone, or eating. There was no alcohol involved. A man was killed in the accident, and I meant no harm,  I was just coming home from my  friends funeral. She had died of breast cancer ( no health insurance). On my way home I took a different road home. I didn't see a stop sign and went through it. I was prosecuted and convicted of negligent homicide.
On the advice of my attorney I went to trial.  I thought we were allowed to go to trial in our country?? Anyway at my presentencing hearing the probation officer, decided and recomended to the judge that I receive 30 days in jail, three years probation, be unable to drive for the length of my probation, and costs and fees. Plus as you know in Michigan there is the drivers responsiblity law. I also have to pay $1000.00 per year for two years. I am also to be charged $65.00 per day for my stay in jail.    I lost my job due to this incident. So far I am unable to return to school. They said I would be unemployable with the conviction of negligent homicide.

 I understand the family that lost their loved one, and has gone through tremendous pain. I never intended to hurt anyone. I apologized profusley in the court room and I asked the judge for mercy.   I had no previous record. I had not had a ticket in over 13 years. My life is has been turned upside down and shaken out and I don't if Ill ever get it together again. 

 While in jail in jail I was denied my medicine. Heath care is also no-existant in jail. I didn't receive blood pressure meds for three days and they didn't give me thyroid for five days. They changed my medications to something I had not been taking,  I broke out in a rash from my neck down. I received medical attention for the rash after 3 days. The doctor then infered he did not know what I had been rolling around with or in- like I was a prostitute off the street.  I was put on predisone and became even sicker after a few days. I pressed the  emergency button and the gaurd told me to write a grievance, she didn't care if I wrote ten. I went back to my cell with a grievance and she locked me in for being sick. Shortly after she took me to the clinic. I called for the sargent to look at me. They said there was nothing wrong it was all in my head and to tough it out.

I dropped the grievance against the gaurd because I saw there was no fighting it. I also had an accident with my horse before incarceration and was wisked out of the court room with out my antibotic for that accident. My leg was on fire and they told me I had a blood clot and sent me back to my cell block. I freaked out I didn't know what to think. I thought the blood clot could burst at any time.They would not tell my husband anything. My husband volunteered to bring my medicines in but was denied because they said it was contriban.

Many other girls experienced similar episodes. One friend lost her baby to a tubal pregancy while inside. They allowed her to sit in pain for a long time before they looked at her. We both went to the hospital together in our hand cuffes. We were happy just to get outside. They found I didn't have a blood clot which relieved me but they still didn't do anything for my pregnant friend. After I went home, they took her to the hospital she told the same gaurd she was in terrible pain but again it was ignored.   We need also to look within our system of justice and look at what happens to people on the inside of jails and prisons. I still do not understand why they put me inside. I had no intent or purpose in what happened it was an accident. Even if my attorney advised me poorly on going to trial isn't it still my right in the constitution? Should I receive a harsher penalty for going to trial? Well I did, I got my thirty days and my life as I knew it ended. I know someone died, I am not making lite of it, believe me I know, I have spent many days in tears and prayers, but I meant no harm. When is an accident an accident? Is it when you can buy your justice?

  Please help me I asked the Judge for mercy and it was not received, can you help or at least look into our jails people are suffering every day. My civil attorney said I should be careful what I write it could come back on me. I had plans to write all my senators and congressmen. I haven't because of what he said; but I have told my story to you and others, in the hospital, in the church services, to the chaplin of the jail. To human service workers. Just think anyone of us could get in an accident at any time. When you see a stop sign think it could be you. There were no alcohol or drugs involved and I only received two tickets in over 30 years of driving.
