
In 2004, Lance Booker was arrested, charged and convicted of 2 counts of 1st Degree Murder and Conspiracy for a crime he DID NOT commit. Despite his claims of innocence and evidence supporting his claim, the judge sentenced Lance to two terms of
Life Without Parole and 8 1/3-25 years. Lance Booker will die in prison an innocent man.
Prosecutorial misconduct, police coercion, rush to judgment, corruption, conviction at all costs, judicial error, denial of right to counsel, witness misidentificatiobn, and perjury were all factors that led to this gross miscarriage of justice. Keys facts surrounding Lance's wrongful conviction include, but are not limited to:
*Lance was a witness who was treated as a defendant. He did not commit murder, nor did he conspire to commit murder. In fact, his actions proved otherwise.
*Althoughe was a cooperating witness, the police and District Attorney refused to investigate any further. It was his defense team that found the evidence and witnesses that uncovered the truth of what happened.
*The police denied Lance his right to counsel after it had been invoked, and later committed perjury by lying about it.
*In a pre-trial hearing, the judge ruled it legal for an attorney to drop his client without notifying or consulting the client. In his ruling, the judge set legal precedent, as current law states attorneys cannot remove themselves from a case.
*The court failed to administer the appropriate oath to the jury. Therefore, the jury
was not legally authorized to pass judgment.
*A motion to vacate his conviction based on the jury not being properly sworn was denied because (1) the issue was preserved at trial-the attorney failed to object [mistake by trial attorney] and (2) the issue was not raised on appeal-[appellate attorney refused to include].
*Lance's co-defendant, the man responsible for the crime, was granted a reversal on the issue of the jury oath (the same issue that was denied in Lance's post-conviction motions) and, at present, remains free and clear of this crime.
*The DA changed the theory of the case without re-indicting, as required by law.
*Lance's conviction was based on the theory that his co-defendant hired him, but conspiracy charges against his co-defendant were dropped. The definition of conspiracy states. "a detailed plan involving two or more people." There simply can't be a conspiracy of one.
*New York law bars cameras from the courtroom, but the judge allowed audio, visual and print media to cover every minute of the trial. The judge then barred the media from the trials of his co-defendants.
Lance is a loving husband, father and grandfather whose guiding presence is greatly needed, and sorely missed, by his family.
