Since OSHA Is Not Enforcing Its Discriminatory Mask Mandate, All Flex Should Suspend Theirs

On November 11th, All Flex informed its employees that it would begin weekly testing and masking of unvaccinated employees in compliance with OSHA's announced Emergency Temporary Standard (ETS) for businesses with 100 or more employees.

After that announcement, a federal court ordered OSHA to "take no steps to implement or enforce" the ETS "until further court order," and OSHA announced that it will comply with the court order. The ETS is now in the hands of the 6th District Court of Appeals, and many believe it will ultimately end up before the United States Supreme Court.

The ETS had two separate deadlines for compliance: December 5th for masking and January 4th for testing. Now that the December 5th deadline has come and gone and All Flex is under no coercion from the federal government to comply with a masking requirement, we request that management suspend its requirement.

It was always immoral and discriminatory to force certain employees to reveal their private medical decisions to all of their co-workers, and it was never justified by scientific evidence. Now that there is no justification for it in the form of an ETS, it should be suspended on behalf of all who support fair and equal treatment.
