In 1993 a timeshare company known as Fairmont Resort Properties began selling timeshares in a developing resort called Riverside in the Kootenay District of British Columbia. Myself, as well as many others, received a Certificate of Leasehold Interest that entitled us to one week annually to use a unit (subject to availability) during a designated time period that was based on a sliding scale of price. The lease was 40 years. This was because the salespitch was that it was Crown Land, and, as such, could never be owned by us. Therefore, only a LEASE. Each year maintenance costs would be paid and if we became in default of said payments the lease would be considered IN DEFAULT and after a certain amount of time returned to the Resort inventory and we would receive a small rebate to cover the outstanding years remaining on the lease.
Religiously, until 2013, we paid these costs. Every year the "Resort" financial reports were only positive. BUT behind the scenes Bankruptcy was occurring. Then came the notice that a major resort renovation was required and that we would need to "pay to stay, or pay to go" thousands of dollars in every case, the "Resort" would be downsized, the name of the "Resort" changed, and a "trustee" appointed to "protect our interests". Little did we know that he was part of the great scam unfolding.
Bankruptcy proceedings invalidated the timeshare companies contracts and Northmont failed to obtain the Leaseholders Rights before unilaterally changing all of our contracts to make us "owners" and responsible for the cost of major realignment and renovation costs, instead of the maintenance costs we signed for in the original contracts. When we sought legal help too late we discovered that our lawyer was not working in our best interests. Now the blackmail to "get out of the resort" has risen from $4000.00 in 2014 to over $25,000.00 per contract due to misrepresentation by this lawyer. Most of our 1300 victims are senior citizens facing the disaster of liens and court ordered judgements against our meager resources. I am a widow, 69 years of age. I relinquished this leasehold but still am being held a financial prisoner by this company. The Civil Courts were not properly available to us due to this lawyer. The mental health of so many has been affected, never mind our finances and futures. Needless to say, there has been no possibility of using the resort weeks we were supposed to be entitled to.
This needs to be tried in a criminal court with fraud charges laid against the perpetrators, Northmont Properties of Calgary, AB., Canada. All civil cases must be stayed and criminal charges and proceedings against the perpetrators undertaken. A mistrial in the civil proceedings thus far is required. This same company, Northmont is continuing to do business here in Canada, their track record of swindling and illegal activities in Mexico, U.S.A. and other areas reads like a horror story on TUGS forums, let's stop this before anyone else needs to suffer the anguish and heartbreak that so many of us are right now!
