Chihuahua Deserves Justice

Chihuahua was run over on purpose by Mr Davis simply because he didn't wish to stop or swerve & hit mailboxes instead; needless to say the dog died within a short time & we're asking for justice regarding this case. Please contact the Sheriff

   This petition is being filed on behalf of a poor little Chihuahua who on the day of 14th of October 2006 in Hallsville, TX was hit by the vehicle belonging to person named Al Davis. 

  A witness to the incident, on this non-busy rural road, (& neighbor to the owner of the Chihuahua), was also at this location trying to call the little Chihuahua to him,  While running across the street, a man named Al Davis, driving a Tahoe and speeding in excess of 60mph was coming towards the dog; rather than swerving and perhaps hitting a mailbox or 2, he proceeded to drive purposefully and without the slightest signs of slowing down, towards the dog and ended up hitting and running the little Chihuahua over.  Al Davis made no attempts to slow down, swerve, or bothered to stop to view the conditions or injury of the Chihuahua that he hit.  The witness of the incident, went directly to the hit Chihuaha and checked for heartbeat, the little dog was barely alive, and was dying very quickly and there was no time to save the little animal due to serious injuries. Witness/neighbor took the dead little dog to the family to make the report and what he had witnessed. 

   Witness knew Al Davis -( witness also took down the license plate number of the vehicle Mr. Davis was driving),and spoke with him after this incident, and the reply stated by Al Davis upon this meeting by witness, "didn't want to hit the mailboxes and did not care of the dog, as it was just a dog

  This little Chihuahua belonged to a family that had children which are devastated at the loss of their companion friend.

  Witness did go to police dept and filed a report, people are asking for investigation & justice under the animal protection laws that are provided by Texas codes. Ss stated below.

 Now, I ask you, this man states this was “Just a dog”; according to Texas Penal Code here is what they say about “just a dog” :Statute in Full: (a) A person commits an offense if the person intentionally or knowingly:
(1) tortures an animal;
(2) fails unreasonably to provide necessary food, care, or shelter for an animal in the person's custody;
(3) abandons unreasonably an animal in the person's custody;
(4) transports or confines an animal in a cruel manner;
(5) kills, seriously injures, or administers poison to an animal, other than cattle, horses, sheep, swine, or goats, belonging to another without legal authority or the owner's effective consent;
(6) causes one animal to fight with another;
(7) uses a live animal as a lure in dog race training or in dog coursing on a racetrack;
(8) trips a horse;
(9) injures an animal, other than cattle, horses, sheep, swine, or goats, belonging to another without legal authority or the owner's effective consent; or

(10) seriously overworks an animal.(b) It is a defense to prosecution under this section that the actor was engaged in bona fide experimentation for scientific research.(c) For purposes of this section:
(1) "Abandon" includes abandoning an animal in the person's custody without making reasonable arrangements for assumption of custody by another person.
(2) "Animal" means a domesticated living creature and wild living creature previously captured. "Animal" does not include an uncaptured wild creature or a wild creature whose capture was accomplished by conduct at issue under this section.
(3) "Cruel manner" includes a manner that causes or permits unjustified or unwarranted pain or suffering.
(4) "Custody" includes responsibility for the health, safety, and welfare of an animal subject to the person's care and control, regardless of ownership of the animal.
(5) "Necessary food, care, or shelter" includes food, care, or shelter provided to the extent required to maintain the animal in a state of good health.
(6) "Trip" means to use an object to cause a horse to fall or lose its balance.
 It is clear that this man, Al Davis, has no remorse for taking a life, simply because the life was not human but of another species, in this case, a beloved family pet. NO ONE has a right to decide what a life’s value is simply based on their species; ALL life should be considered equally important and if you have the option to take down a mailbox rather than hitting a dog, I think that anyone with an ounce of compassion or humanity would choose the Mailbox without giving it a single thought. Now this man chose to take a life on purpose, thereby, creating incredible pain & suffering for this poor Chihuahua, on top of that, he didn’t even bother to check how the dog was after he hit him intentionally, like a pebble or a can and upon confrontation he gave a calloused remark and basically couldn’t care less about the animal. Someone of this vile a character who has ALSO  broken SEVERAL Texas laws concerning the welfare of animals needs to be properly punished and not just a slap on the wrist for this offense.  He has taken a life intentionally & in the process, broken several laws and he MUST BE PROPERLY PUNISHED for this.  I ask Justice of the Peace Mike Smith to give Mr. Davis the fullest and harshest sentence under the laws that he has broken.  It must be shown that these animal welfare laws which are written are fully enforced when they are broken for without the proper punishment, the laws mean nothing & aren’t worth the paper they’re printed on.
