Chapter 74 E Is a violation of the 4th,5th,10th, and 14th Amendments of the united states constitution. This is because it enables private police to operate on propertys such as hotels and apartment complexes.  Enabling a statute that delegates arresting power to privately owned police forces and allows them to not have to follow search and procedure violates the 4th,5th,10th, and 14th amendment...This obviously violates the 4th amendment because it voids the right of regulated search and seizure...private entity's do not have to follow search and seizure procedures because they are private corporations. This also correlates with violating the 5th amendment which states that no person shall be held to answer for a crime without due process of law.If these companys are allowed to violate search and seizure then there is no just due process of law..The 14th amendment states that all states shall not enforce any law that violates citizens rights..This law /statute is an obvious violation of the citizens of nc rights, which is a violation of the 14th amendment.. Also this statute violates the 10th amendment which states that powers not granted to the federal government are reserved to the people and the state" Delegating policing powers to non state funded institutions is not delegating policing powers to the state or the people. It is delgating powers to corporations. No one can argue that giving powers only reserved to the people and the state that are given to a Corporation are constitutional and just. I and many people believe this to be a threat to the freedom of the people of this state. With enough signatures I hope to be able to get sponsorship by members of the Nc Senate and House, in that we can delegate power away from private police..

Despite the 10th amendment granting the states with policing power. North Carolina decided to pass and enact Chapter 74E, Which is a clear violation of the 10th amendment that reserves policing powers to the states and the people. This also allows no due process of law which is also a violation of the fifth amendment. Duke Law is writing about this issue concerning that private police are not held to constitutional limitations found in the bill of rights. Which also correlates with upholding the fourth amendment of reasonable search and seizures. 
Many north Carolina citizens have been profited off of, hurt, and personally violated by this unconstitutional statute. Another problem with this issue that impedes on personal liberties is the ability for the private mercenaries to cite frivolous infractions to any one that may be present on the property these private police are contracted too, and enables these CORPORATIONS to profit off of these insignificant infractions that are no threat to public safety. Hundreds if not thousands of Nc citizens are traumatized every year by these organizations.

Section 1: The use of private police should be limited to State funded institutions or places that act as state funded institutions. Ie: University’s or private schools. The fine line of exception being those with notable risk of attack based on their political opinions Ie: Lawyers, politicians, Scientists. And only for the protection of these individuals not to profit off of insignificant citations. It would be hard to hold these institutions legally liable if used in any other manner.

Section 2: All property seized by private police previous to this bill must be returned to their rightful owner based on their request and after civil proceedings of the courts. 

Section 3: All Private police must be educated and pass approved testing by the state attorney general regarding their employees individual understandings of Due process of law and the Bill of rights.

Section 4: Private police are not to be used to profit off the peoples pockets based on infractions that pose no danger to the public. Ie: Squealing tires in the rain in a accidental non wreck less manner.

Section 5: Private police are not to be used by govt subsidized companies/programs that cover an area of more than one square mile unless voted on by the people. And are not to be placed in close proximity without a public hearing/vote. This must be regulated by a special legal counsel of the state attorney general of Nc who is voted on by the people on terms.

Section 6: All donations by private police to political parties must be prohibited.

Section 7: All private police should be held civilly and legally liable for follow all constitutional procedures.
