U.S. CITIZENS WAKE UP BEFORE IT'S TOO LATE
- by: Jane Branson
- recipient: U.S. ATTORNEY GENERAL, REPRESENTATIVES OF CONGRESS & CITIZENS
THIS IS A "MUST" READ!
PULL BACK THE CURTAIN TO SEE YOUR FUTURE
FOLLOWING ARE MY RECOMMENDATIONS TO STOP ELDER ABUSE.
PROTECTING OUR SENIORS IN OHIO & AROUND THE COUNTRY.
If you want to WAKE UP Ohio Citizens and the American Public about ELDER ABUSE, let them SEE with their own eyes the unnecessary physical injury, pain, mental anguish, violation of rights, financial loss and dying prematurely our ELDERS have endured for years because predators of the Elderly, saw flaws in the Legal System and used it to their advantage to rob, control and even murder our older Americans. Now with the Baby Boomers coming of age to retire, more Predators will be on the hunt for their innocent victims. The time has come for the curtain to be pulled back for the AMERICAN PEOPLE, to See the reality of Our Future. Until one lives through this pain of unending agony, there is no possible way of understanding the crisis America has at it's front door. Our State Leaders must Now acknowledge the over-whelming evidence of Elder Abuse in Ohio as well as the Country. No matter what your income or status, you will Not be Unscathed from the dangers that lie ahead waiting for you in your old age. To put an end to this insanity, Each STATE must Now Expedite New Laws and Regulations as if a building was on fire and infants and small children were inside the burning building. Our Older Americans have waited far too long for valiant, courageous men and women in Authority to STOP the Negligence and Abuse of our Older Americans.
CONTACT YOUR STATE ELDER ABUSE COMMISSION, YOUR STATE REPRESENTATIVES, EMAIL, POST YOUR COMMENTS ON GOVERNMENT WEB SITES FOR CONGRESS TO EXPEDITE NEW LAWS AND REFORMS BEFORE THIS CRISIS IS TOO OVERWHELMING TO CONTROL.
DO NOT STOP UNTIL THE ELDER ABUSE CRISIS HAS BEEN RESOLVED OR WE WILL BECOME THE NEXT VICTIMS OF ELDER ABUSE!
JANE BRANSON'S RECOMMENDATIONS TO STOP ELDER ABUSE.
1. The Elder Abuse Commission should collaborate with the National Association Against Guardian Abuse. They have researched their information and have numerous stories from people from all walks of Life in the United states, that have experienced horrific Elder Abuse crimes. The stories would show where new laws and regulations need to be implemented. The stories should be shared with Ohioans and the American Public to make them aware Elder Abuse is happening in every State of our Country.
Following contact can offer a world of insight into Elder Abuse in America
a. NATIONAL ASSOCIATION AGAINST GUARDIAN ABUSE, NASGA
A PICTURE IS WORTH A THOUSAND WORDS.
2. It is recommended The Attorney General's Elder Abuse Commission in Ohio and All states, run 60 second commercials about Elder Abuse on TV, Radio, Newspapers, Mailings and Billboards, perhaps contact CNN. The media can run the commercials as a Public Service. You can simulate the commercials from the Elder Abuse stories that thousands of victims have reported to NASGA.
It will be very affective! Many Elders living alone or in nursing homes do not have a Family Support Team. Many are alone without anyone or have been isolated from family and friends by some guardians who have deceptive motives to control them.It would be very beneficial if Ohio Attorney General Richard Cordray, along with other High Profile Individuals in Ohio, as well as other State Representatives could be included in the commercials, explaining to Ohioans and All American Citizen's, IT IS EVERY CITIZENS RESPONSIBILITY THROUGH OUT OUR NATION, to take part, to Help Save our Elders through this Crisis. " We can no longer walk away and think our Elders are Safe among Strangers. Our world is filled with corruption and its getting worse. Every single Ohioan and U.S. Citizen can do (something) no matter how big or small to help!
IT'S TIME THE PREDATORS KNOW, AMERICA IS NOW WATCHING AND PROTECTING OUR OLDER AMERICANS!
3. The Judicial Courts, Attorneys, Nursing Homes, Pro Seniors, Ombudsman, The State Health Department, All Agencies on Aging must be presented with new laws, rules, regulations, procedures and Training!
NASGA Reports, the statistics of Elderly Abuse clearly show, Elder Abuse is running ramped in America. with all due respect to above, the system is Broke and must be Fixed. It is my opinion, the old rules and regulations are too lax.The above are following inadequate laws and regulations that are out of date and lack common sense and humane decisions for our Elders.
The whole system has been going through the motions of a inadequate, hand-book procedure, refusing to acknowledge for years the serious problems of Elder Abuse. Its time for all of us to wake up, set blame aside, initiate a plan of action and Save our Elders from these Predators!
4. The first Priority our Authorities must acknowledge and consider is the Elders medical and personal needs, what is in the Elders best interest. Our Elders wishes, must be acknowledged and their voice heard in our Judicial Court system, whether competent or not. Elders who are disabled with Dementia Still Have Rights, this is not being acknowledged in our Judicial Courts and clearly must be addressed.
Bear in mind, our Older Americans have already paid their dues in lifes challenges, paid into the system and paid their Taxes. Our Elders Deserve to live out the rest of their lives in a safe, healthy, content environment, whether that is at home or in a nursing home. Our Judicial Courts need to give the Elders that choice especially, if there is family willing and able to care for the Elder at home.
It has been my experience the Court only acknowledge the Attorneys, Conservator ship and Guardians without any consideration for the Elder or their Rights as an American Citizen.
The Judicial Court condemn family members and treat them as if they've committed a crime because they want to care for the Elder at home.
It is time the Courts acknowledge the Elder and become supportive of the Elders best interest and needs. The Courts should never be allowed to remove an Elder from a healthy, safe, loving home environment, especially when they are still capable of staying at home with or without a caregiver. It is only common sense anyone is going to be happier, more healthy and more content at home, around familiar surroundings, with family for as long as possible.
The Real Crime is the Judicial Court allowing a guardian who is not suitable, who robs the Elder of their life savings, the Elder is forced in an institution, where they are forced to live among strangers, isolated from family, many times neglected and abused, to die alone.
The Elder Abuse Commission can request from NASGA, videos of Elders who have been harassed by Adult Protective Services. One video shows an Elder being coerced to become a Ward of the State. It will enlighten the Commission and America to see these videos. It's very frightening because it reveals Our Future.
5. A guardian must be removed if they are causing physical and mental anguish of the Elder for purposes of control to rob the Elders estate and life savings. A new system and procedure must be put in place where the guardian must answer to Elder Accountants, they will have knowledge of the Elders Assets to make sure a Guardian, Conservatorship or Family member is not Stealing the Elders money property or assets. These Accountants will network with the FBI to keep eveyone honest.
It is my recommendation the Commission must now act and initiate New Laws, Procedures and Easy to read Forms to Stop Attorney's, Conservatorship, and the Court System charging the Elders Astronomical Sums of money depleting the Elders estate and life savings. This is a despicable crime!
6. A new law must be put in place, the Elder cannot sign any documents giving another person power over them, unless two, perhaps three Doctors, that have been Trained in ( Elder Mental Capacity) find the Elder competent and in sound mind.
7. Trained, Advocates delegated by the Commission, must be assigned in all Ohio and State Counties. It must be mandatory, they are present to explain to the Elder, in (Simple Terms) exactly what they are signing and what will happen to their estate and person, if they become incompetent.
In order for the Elder to express (Their) wishes, the Commission's, Appointed Advocate must explain in detail, (Simple Terms) to the Elder about resuscitation. The Elder must understand, they have a Choice to be resuscitated. The Court Appointed Advocate, must make it clear to the Elder if they become incompetent, the person who they're signing their rights over to, will have full power over them unless stipulations are put in place at the time the Elder is competent.
The Commissions, Trained Advocate, must make it clear to the Elder, "they can make Stipulations and change their Will, Health P.O.A. Documents, etc. at any point in time, unless the Elder is not in sound mind, which could relate to various health reasons.
NOTE: NEVER, should a guardian have the Legal Right to Remove safe, loving family and friends from the Elders life. The only exception would be, if the family member or friend has beaten the Elder, with intent to kill or devious act.
The Commission's Appointed Advocates, will carry the Authority and Legal Training of THE ATTORNEY GENERALS, ELDER ABUSE COMMISSION! The Commissions Appointed Elder Advocate, will review the documents, once confident the documents are Legal and they feel confident the Elder understands what they are signing, the Commissions appointed Advocate will sign the documents as a witness, confirming the Attorneys documents are legal, in order, and the Elder understood what they signed. This will levitate dishonest family, friends, attorneys, Judges and Conservatorship Agencies from taking advantage of an Elder who is competent or not competent.
NOTE: No longer should an attorney's employees sign off, as witness's, on documents stating the Elder is in sound mind. The Attorney's employees, do not know the Elder, they are not Doctors and they do not know the Elder's medical history. The employees are surrendering to undue influence. It is the reason many of our Elders have fallen between the cracks of the legal system and been taken advantage of. My Mother, Mollie Florkey was one of them.
8. A statement from a Doctor that is trained in (Elders Mental Capacity) must be included with all documents. If the Elder makes changes in Wills, Trust, etc. a new statement from a doctor, trained in (Elder Mental Capacity) will be required. It is important to determine at what age should a person be required to include a medical statement when making out their Will, P.O.A. etc.It is wise to make it mandatory in each State, every person at the age of thirty should have a will. The procedure should be made simple.
9. NOTE: It will be necessary for Hospitals to have Trained Doctors in Elder Capacity and the Commission's Legal Advocates on staff in case any changes are made on the Elders death bed of their First Will. If possible, tape recorders should be placed in rooms of patients near death and only turned on in case the Elder request a change in their will. The Trained Doctor in Elder Capacity, will be able to determined if the Elder is in sound mind or under duress from another party to change the First Will.
It is my opinion if the Elder makes any changes of their First Will on their death bed, all parties included in the will, must be present or on cell phone audio to confirm the Elders wishes. The Trained Doctor in Elder Capacity (Must Be Present) to determine the Elder is in sound mind, is not coerced, manipulated or harassed to make changes in their First Will by another party.
If all parties included in the First Will, Cannot be Present or on cell phone audio, or if the Hospital, Trained Doctor in Elder Capacity, Cannot be Present confirming the Elder was mentally sound or confirm, there was no coercion of the Elder by another party, the Second Will the Elder made on their death bed, will be null and void, Unless there is clear evidence of deceit and fraud of the parties in the First Will.
10. The State may want to consider at the time Ohioans renew their drivers license or licenses plate, at the Licenses Bureau, another window at the License Bureau should be opened for Ohioans, mandated update, on a Living Will, Power Of Attorney, etc. (A short form, either yes or no, a Will is in place.) Everyone should be required to have a Will at the age of Thirty. At Sixty Five it should be mandatory everyone have a Will and elected a person as their Power Of Attorney, etc. which can be updated and changed at any point in time until a certain age, then a statement from a doctor trained in Elder Capacity will be required. This will eliminate many problems for families and the Judicial Court System. All immediate family members (siblings) should be notified by letter of the persons decision, of the person elected as P.O.A. Health P.O.A. etc. for various reasons.
It is unfortunate predators already have mislead many of our vulnerable Elders into signing over their estate and life savings. The predators cover up their crime by forcing our Elders in nursing homes where they are neglected, abused and die prematurely. With new Laws, Regulations and training, Local Police Force, Ombudsman, the State Health Department, Adult Protective Services, All the Agencies on Aging can put a Stop to the negligence, abuse and cover up in private residence and nursing homes.
11. The Local Police Force, Comission's Elder Advocates/reporters should view videos of Elder Abuse. It is important to read the Elder Abuse Stories happening all over the United States. Refer to the (National Association Against Guardian Abuse, NASGA)
The Commissions Elder Advocates need to be Trained by Professional Officials, FBI or Local Police who have updated and Trained their Officers with information about Elder Abuse. Elder Advocates must be trained to understand when an Elder is being isolated and controlled.
If there is suspicion of Elder Neglect or Abuse, it is unrealistic for the Elder advocates/Reporters to spend one day at a nursing home facility to determine if an Elder has been abused. The Facility knows the moment the Elder Advocate walks in the door, the word goes out fast. The nursing home staff or abusers will quickly cover up any abuse or neglect.
NOTE: Bear in mind medical records can be altered. It is important not to ask open end questions to Elders with Dementia. It is unrealistic to talk to an Elder with Dementia who can't remember five minutes ago and expect to find out from the Elder if they are satisfied with their care or if they are satisfied with the guardians choices or decisions the guardian has made on the Elders behalf. The Elder with Dementia has no idea what decisions and choices their guardian has made on their behalf because they can't remember what the abusive guardian has done to them.
The Elder has been locked up in a small confined room, isolated from family and friends. This is the reason our Elders need to be Protected by dishonest guardians and corrupt Conservatorship that have exploited and robbed them, which is why Elder Abuse is escalating in Ohio and around the Country, because No One is Stopping these Predators. They know the Law allows them to get away with it.
In an investigation of Elder neglect and abuse, Ohio Pro Seniors/ Ombudsman and The Ohio State Health Department are only allowed to talk to the guardian and the nursing home staff. The Advocates/Reporters are not allowed to talk to other family members, friends or outside witness's, that could help prove the Elders negligence and abuse.
Example: If the nursing home staff is neglecting the Elder and the guardian allows the negligence and the Advocates/reporters Are Not Allowed to talk to witness's outside the nursing home, that have witnessed the Elders negligence or abuse, then how can the evidence of neglect and abuse be reported? Not gathering ALL evidence of a crime in an investigation is the reason our Elders continue to be neglected, abused and murdered. This is Not acceptable!
NOTE: Pro Seniors/Ombudsman, The Ohio State Health Dept. confirm they cannot do anything about the Elders abuse, unless the guardian who is Allowing the abuse, reports it. That is a frightening statement! Changes in rules and regulations must be made immediately to Rescue our Elders.
12. The Elder Abuse Commission must step in and help families with restrictive incomes, that cannot afford to hire an attorney, to help rescue the Elder from abuse and negligence by the judicial court system, a guardian, or a nursing home. The Elder Abuse Commission must understand time is not on the Elders side and removing Elders from a abusive situation must now take precedence. State Authorities must remove Jurisdiction Boundries and Save the Elder.
THE ESCALATED NUMBERS OF ELDER ABUSE in OHIO & THE NATION PROVE THE SYSTEM IS BROKE.
It is recommended, ATTORNEY GENERAL RICHARD CORDRAY, can no longer be removed from the Legalities of Elder Abuse in the Judicial Courts in Ohio Counties and refer Private Citizens to hire an attorney to Save the Elder from Negligence and Abuse, when they cannot afford to hire an attorney. My experience, as well as many others, who can give testimony, have been abused by a Corrupt Judicial Court system that make up their own rules, shows favor and bias to attorneys who have their own personal agenda, without regard to Save the Elder and gives guardianship to individuals that are not suitable, who then put our Elders in Harms way.
We have witnessed the Judicial Court show no regard or consideration for the Elder and Failed to acknowledge the Elders Constitutional Rights which result in the Elder being robbed of their estate, life savings, then imprisoned in a nursing facility where they die prematurely of neglect and abuse.
THE ATTORNEY GENERAL MUST PUT IN PLACE A STATE ELDER LAW ATTORNEY TEAM IN ALL COUNTIES.
Attorney General Richard Cordray has Committed to STOP Elder Abuse in Ohio. It is recommended Attorney General Richard Cordray initiate immediately, a Team of Elder Law attorney's Trained in testamentary capacity, Wills, Trust, Estate, etc.The Attorney Team will Report directly to the Attorney Generals Office and will have Authority to Over-Power a Judge, Attorney, Guardian, any Elder Agency or Nursing Facility in order to PROTECT the Elder, their Best Interest and their Constitutional Rights.
Only judges trained in testamentary capacity and Elder Law will have the legal authority to make decisions of the Elder's life, along with the assistance of the Commission's Elder Law Attorney who will defend the Elders Rights and Acknowledge and Consider what is in the best interest of the Elder
It is recommended each city and town be represented by one of the Attorney Generals, Attorney Team. Depending on the size of the city or town in Ohio, will determine the number of attorneys assigned. They will work directly for the State and be paid by the State for their High Performance accordingly. The Attorneys in the surrounding Counties on the Team, will join forces if any Commission Team Attorney has over load. With new Laws, Reforms, Regulations and the Attorney General Richard Cordrays, Special Attorney Team at work Protecting the Elders Rights in a Judicial Court system will put a STOP to Predators from Robbing, the Elder of their Estate, Life Savings and the Elder being forced in a nursing home facility to be neglected and abused to die prematurely.
13. The Elder Advocates/Reporters when investigating the Elders negligence, must Not assume because a person has a chronic condition, it is the reason the condition is not healed or the Elder is not well. It is a proven fact in many cases if the Elder is given Consistent daily medical care, per Doctors orders, the chronic condition can be controlled and even healed.
The Commission Elder Advocates/Reporters need to start asking Why is the Elder in this condition, Why has the Elder gotten worse? Why is the elder in a nursing home? What was the Elders condition in their home environment? The investigation should be reviewed starting at the beginning of the Elders care at home to present. The rule to only discuss the Elders negligence and abuse with the guardian and nursing home staff is Not acceptable. All evidence from Family members, friends, outsiders who saw the negligence and abuse should be Included in the Elder Advocates/Reporters Report.
Suggestion: Have all involved take a lie detector test.
OUR ELDERS CAN NO LONGER DEFEND THEMSELVES.
14. It would be in the best interest of our Elders in Ohio & the Nation if The Elder Abuse Committee (Task Force) assign (Trained) Officers twenty fours a day to work at all the nursing homes in Ohio & the Country. Cameras in all residents rooms except the bathroom. Monitors with audio need to be put in place in a designated area for the Officers to over-see the protection of the Elders. Baby Cams installed in rooms with Elders who have Dementia and Alzheimers. There should be audio in the bathrooms for the safety of the Elders. The Special Task force Officers should make their presence known through-out the nursing home and be included in all meetings. All three shifts must have, Under-cover nurses, aides, maintenance workers, cooks, etc. They would be compensated for their efforts in reporting negligence, abuse and theft.
15. Management in nursing homes need to understand their first priority is the health and safety of the Elders. Management in nursing homes must understand, it is not legal to conspire with a guardian or others to hold an Elder prisoner without legal documents. Nursing Home management must understand, it is not legal to conspire with the guardian or others to knowingly and willingly defame an innocent persons character in order to stop the person from advocating the Elders Right to return home.
Nursing Home management must understand it is illegal to knowingly and willingly conspire with the guardian and others to Stop the Elder returning home by harassing the Elder, or their family members causing the Elder physical and mental duress that could possibly cause the Elders death.
16. There still remains in our society a good ole boy network that must be eliminated from the court system. The (Elder Advocates/reporters) need to have the Support and Back Up of ATTORNEY GENERAL RICHARD CORDRAYS, ELDER ABUSE COMMISSION to remove all Fear of any Threats or Retaliation by the Judicial Court system, the guardian and the nursing home.
TOM FIELDS, who has been fighting for over six years to establish new reforms and protocols because his Father was a victim of Elder Abuse reports UPDATED TRAINING WILL STOP PREDATORS OF ELDER ABUSE. Tom reports following:
Drs. Hall et. al. point out in their June 2009 Clinical Geriatrics article. "Most doctors, even those who primarily see patients of advanced years, are not knowledgeable about key issues surrounding testamentary capacity. A study in 2002 found that only 7% of general practitioners, psychiatrists, geriatricians, and medical students near completion of their training could answer basic questions regarding testamentary capacity." and "It is not uncommon for persons who exert undue influence over a testator to try to incorporate professionals such as doctors, lawyers, or accountants into their efforts to control the individual".
With such observations in mind, Tom Fields recommends that before we give anyone the authority for doing the job that needs to be done, we need to have the laws in place to ensure that they do their job right. Tom Fields recommends "our first priority must be to put in place the needed legal reforms, including laws establishing the practical protocols which are to be followed by those who receive the training. Otherwise we will end up with a situation like that here in Ohio, where Adult Protective Services provides inadequate training for its workers because APS lacks the needed protocols an important fact which was implicitly acknowledged in 2006 by Section 5101.651 of Ohio House Bill 563 whch begins on line 627 as follows Sec. 5101.651. (A) Each county department of job and family services, in conjunction with the area agency on aging that serves the region in which the county is located, shall prepare a memorandum of understanding prescribing the normal operating procedures to be employed in the investigation of a report of adult abuse, neglect, or exploitation made pursuant to section 5101.63 of the Revised Code.
The memorandum shall comply with the requirements established by section 5101.65 of the Revised Code for such investigations. The memorandum shall have as its primary goal the utilization of a structured and systematic investigation protocol regarding the reports. The memorandum may be based on the model memorandum of understanding developed by the department of job and family services under section 5101.62 of the Revised Code.
Tom also suggests that we need to require training in such procedures of all mandatory reporters -- persons identified by the above bill under Section 5101.63(A)(2) which begins on line 453 of HB 563. Tom has also identified a need for very real and serious consequences for those who do not follow the protocols, including judges who might not enforce them.
The current laws addressing the failure of a mandatory reporter to report are totally inadequate, as are the current laws which permit mandatory reporters to use the excuse that they did not have a "reasonable suspicion" "reasonable suspicions" must be supplemented by stipulating specific conditions and circumstances.
In addtion to agreeing with what Tom recommends, I believe the ELDER ABUSE COMMISSION needs to contact the Ohio Medical and Nursing Boards and recommend that they respond to the large number of reports of Elder Abuse in Ohio by expediting the training of medical professionals in how to handle circumstances most likely to raise concerns about testamentary capacity, undue influence, an/or fraud should be required.
The Elder Advocates/Reporters need to work in teams when they're investigating Elder Abuse. Theyre job is to find out, if there is any evidence of abuse or negligence, this means talking to All witness's. The Elder Advocates/Reporters must be Hands On, to determine negligence.
They cannot go in and ask Elders general, open end questions then leave. Commission Advocates/Reporters, once on the facility site, must Observe, if aides start running to Elders rooms. That's where you start first, they're trying to cover up the neglect. The Commission advocates/Reporters/(Nurse) need to look at bedsores, they must check to determine if the Elder is sitting in urine and feces. Check for other wounds on the body. Don't ever assume because the person is old they must live with pain and mental anguish, don't just talk to the Elder, examine them! Does the Elder have a bad odor? Is their bed clean? Are their clothes clean? Is there a bad odor coming from the bathroom? Can you distinguish the smell of the bad odor in the room from the odor in their food served them? Are they in bed or sitting in a chair with their legs down? Do they look pale? Are they depressed or sad? Have they lost weight? Ask the Elder who they miss seeing.
Find out if there is a family member willing and able to care for the Elder at home. Find out if the Elder needs skilled care, Find out from the Doctor, if the Elder can return home. NOTE: Through out the United States many Elders have been forced in nursing homes because they were taken advantage of by greedy predators. There was no reason the Elder had to be forced in a nursing home, many can return home. The state is paying out thousands of our Tax Dollars to nursing homes for Elders that can return home, be a lot happier, healthy and surrounded by loving family willing and able to care for them.
There should be a Law Protecting our Elders from this crime.
The Elder Abuse Commission should send in Authorities to review the Elders files with the nursing home Doctor's, to determine which Elders can return home to family who will care for them properly.
The Elder Abuse Commission should make All Elder Advocates/Reporters aware they are very valuable in the protection of our Elders. The Elder Advocates should be informed, they will be recognized, awarded and recommended for higher status and pay by contributing they're valuable ideas, that will improve the system and keep our Elders safe.
GOLD PIN OF RECOGNITION:
17. Any person that wears a Gold Pin with the ATTORNEY GENERALS RICHARD CORDRAY'S ELDER ABUSE COMMISSION, should be recognized throughout the Ohio Government System as a person of Honor and Integrity in their help to STOP Elder Abuse. A Special Ceremony awarding these Special, Gold Pins to those that have contributed and expedited ideas and plans that work, will be awarded the Gold Pin Of Honor and Integrity by our own Attorney General Richard Cordray along with a Promotion. That in itself, would be an honor and a wonderful goal to reach for.
We all understand, taking care of the elderly is hard work. It takes long hours, sweat, tears, patience and nerves of steel. Our Elderly took care of us when we needed them, now it's our turn! If we all work together we can do it!
18. One of the reasons Elders are neglected is because the nursing homes are short of help and to Save money management will bring in a skeleton crew.
The Commission needs to do a study, find out how many aides and nurses are on each shift and how many Elders they're assigned to.
Not having enough help contributes to the nurses and aides getting burned out, they're tired and over worked, which contributes to poor performance and neglect of the Elders.
The nurses and aides deserve to have Bonus's and special perks, they deserve it, they're taking care of our love ones. Assign a Experienced, time manager who can crunch the numbers to make sure nursing facilities are staffed properly.
America has intelligent, motivated people that can find the solutions to this horrific abuse of our Elders, we all must get involved.
A special program to help the Caregivers that take care of our Elders at Home should be put in place.
THE ELDER ABUSE COMMISSION MUST HAVE ON THEIR TEAM, PEOPLE THAT HAVE EXPERIENCE IN ELDER ABUSE.
19. Separate all the Elder Abuse problems into categories. Assign a group of people who have the knowledge and expertise in each category to resolve that particular problem. Assign a Group Leader for each category. Tom Fields and his resources would be beneficial to the Commission in reference to Wills, Estate, Trust etc.
20. A person with Advertising, Promotional and Creative Background to implement the TV, Radio and Newspaper Ads will be needed. It would be very beneficial for the Commission to collaborate with the (National Association against Guardian Abuse, NASGA) to give them a understanding of the Elder Abuse Crisis.
21. Assign an FBI Agent, perhaps a retiree to collaborate with above resource to properly train the Elder Advocates/Reporters. Also, a suggestion is to assign a retired nurse, that has experience in nursing facilities to aide the FBI agent. The more people with experience in Elder Abuse, will expedite the Rescue.
22. Assign a time management person that can determine the number of aides and nurses needed for each eight hour shift to care for the Elders properly. This category will be a challenge because management refuse to hire more personnel to adequately care for our Elders and is one of the major reasons the Elders suffer from neglect.
23. Without the nursing facility's knowledge, assign a retired nutritionist to determine if the foods being served are healthy, does not smell and is not sickening to the taste. It may be a good idea to stay on site for one month and experience eating the food being served to the Elders. Elders have refused to eat because the food had no taste. This is not appropriate. If you have the food why not prepare it in a manner that taste Good. NOTE:. Challenge the food Network, Rachael Ray, who is a talented chef, could submit a variety of healthy, tasting menu's that will appease an Elders appetite and still stay within the food Budget.
24. Some of the beds the Elders sleep in are positioned in front of the bathroom. Do you have any idea what's it like to eat your meal after someone uses the bathroom. Even if the elder was hungry, after smelling the bathroom stench they've lost their appetite. It's insensitive and cruel. Some nursing homes, only have room for a bed, which means the Elder must stay in bed all day. If they have to keep their legs elevated most of the day, there is no option to sit in a chair to elevate their legs and enjoy their room. Can you imagine spending the rest of your life in a bed, especially when you don't have to?
Many Elders have to lay on their side to even watch TV in their room due to lack of space. This is insensitive of the Elders simple needs. It is recommended to assign a person who understands the simple skills of organization in order to give the Elders more adequate space to maneuver around with their walker, wheel chair, and still have enough room for a chair. It will prevent fatal falls.
The above recommendations are the problems I have witnessed in the last six years since my Mother, Mollie Florkey was illegally forced in two nursing homes, while I was forced to watch my Mother put in harms way to be neglected, abused and forced in a prison where she has been isolated from family by a guardian for over two years.
My Mothers life was destroyed by a guardian, her beloved home sold against her wishes, she was forced in a nursing home, isolated from family and friends to die alone because of inadequate Laws, a Bias Judicial Court that ignored her Constitutional Rights because she grew old and could no longer defend herself.
