The Invisible B.C. Government and Your Property Rights!


In May, 2005 I started my research on parking enforcement in the City of Vancouver and discovered an embezzlement scam that involved the Vancouver City Council, the Land Registrar, the Law Clerk in Victoria and a member of the Legislative Assembly.  This scam amounts to "billions" of dollars and involves the theft of private property rights that belong to those who built and dedicated highways.


Highways were originally built by land developers who then dedicated them to the public

for the purpose of passing and repassing.


Before 1953 all highways in the city were owned by the City of Vancouver except as described in the Vancouver Incorporation Act 1921 319 (1) as Every public street, road, square, lane, bridge, or other highway or public place, in the city shall become absolutely vested in fee simple in the city are (subject only to any right in the soil which the individuals who laid out such road square, lane, bridge, or highway may have expressly reserved).

What were those rights?  When developers dedicated highways, they dedicated the tar and cement or that part of the highway that is used by the public for passing and repassing.  It was never understood that the rights in the soil were to be transferred to the City and, that land owners still maintained full estate in the soil of the highways.


Research suggests on the Norfolk County Council web, that the English recognize the rights of the owners of the highways.  In the preamble of the British North America Act 1867 it states that the constitution of Canada shall be similar to the constitution of England.  The Norfolk County Councels web page is http://www.norfolk.gov.uk/consumption/idcplg?IdcService=SS_GET_PAGE&ssDocName=NCC027433&ssSourceNodeId=&ssTargetNodeId=130


A particularly reveling explanation as to who owns the roads in England/Canada/America is this excerpt from the above link. 6 My deeds show that I own the land you say is highway. Does this mean it isn't a highway?


As the Highway Authority, we rarely own the land which the highway runs over. Most people own the land up to the middle of their road, but don't realize it is only the subsoil that they own and the control of the land and its surface lies with the Highways Authority.

Not only is this possible, but is often the case. The highway rights exist over subsoil not owned by the Highway Authority.

How is it that the people of Vancouver once had rights to the soil and now these rights do not exist?

In 1953 when Vancouver first received its Charter, the rights in the rights in the soil went from those that built and dedicated the highways to the City of Vancouver.  Our concern is, how did they get the rights to property that existed in the soil?  Who is responsible for denying our rights to property?  Was it within the power of the legislature to give peoples rights of property to the City Of Vancouver? Please note that every other municipality in B.C. still retained these rights in the soil.

In 1973, the Vancouver Council was told by Legal Services in Victoria that if they could delete the sentence from section 289 of the Vancouver Charter "and to any right therein which the person who laid out or dedicated such street may have expressly reserved" they could then get title to stopped up highways: something they could not have otherwise done.

Did the Law Clerk in Victoria know that the City Council would all co-operate in the theft of our property?  If one person objected to that motion it could have been struck down as being unconstitutional.  I submit to you no one objected or if someone did they did not voice their objection or if someone did object, this objection was simply ignored.

We the undersign recognize that it is your mandate to give legal advice to other government agencies and ministries and we wish to bring to your attention this administrated crime of embezzlement of private land that was held in trust by the city of Vancouver for the purposes of highways.



We the undersign demand a full investigation into the theft of private property by the Vancouver City Counsel of 1973 and certain members of the B.C. Legislature when at the time they passed Bill 50 section 23 An Act to Amend the Vancouver charter . This act deleted illegally the sentence and to any right therein which the person who laid out or dedicated such street may have expressly reserved.



We demand that those rights to the stolen property be recognized and reinstated by the legislature and that the word "soil" is reinserted as it read in the Vancouver incorporation act 1921 Section319 and as it read in the local Government Act 1996 Section 524 (1).



We demand that where land has been taken and sold that the monies be redirected to the rightful owners of those lands.
