Re-open for Ramo

 
Dear Friends,

Having just returned from a year working in Bosnia, it was deeply painful for me to learn that a young Bosnian man, a torture survivor, was denied asylum in the U.S. and has been sitting in jail for the past few months in Virginia awaiting deportation.
Ramo Rustemovic is a 29-year-old Bosnian Muslim from Srebrenica. It is likely that the immigration system's denial of his asylum application was at least in part on account of his religion. His case, however, is not so straight-forward. Ramo is married to an American citizen, with whom he is raising two infant children, also American citizens. For the past two years, Ramo has worked at the same Virginia company, and his employer has nothing but rave reviews for Ramo's work there.

Although Ramo survived three years in a Serbian concentration camp, lost both his parents, and was brutally tortured, this young man was denied asylum by the US immigration courts. Now, he is again in prison, this time in Virginia, awaiting deportation. If deported, the soonest he could legally return to his family is 2017.

 Dear Mr. Osuna,Dear Mr. Orland, We seek your support for the re-opening of the case A78 156 085, regarding a Mr. Ramo Rustemovic. We understand that you have outstanding records of service within your respective branches. Therefore we appeal to your good judgment to reopen the Rustemovic case – Mr. Osuna, by way of sua sponte; Mr. Orland, by agreeing to a Joint Motion to Reopen. Justifications for this include the surfacing of new facts about Mr. Rustemovic’s previous persecution not present at his first asylum hearing. Furthermore, a change in the law since his appeal permits Mr. Rustemovic re-adjustment of his status. He is in a loving marriage to an American woman, the evidence of which are two American children they gave birth to, from whom he would be separated for 10 years should he be deported. The couple already has an approved I-130 alien relative petition. These developments, plus manifest injustice and compelling circumstances, demand a fresh inquiry into Mr. Rustemovic’s case.  We as supporters of human rights know and believe that an individual from the town of Srebrenica who was tortured in the war as a child and whose parents were killed in front of him, should not be forced to return. It is completely inhumane. We, the undersigned, thank you for your time and consideration.
