Stop policing for profit- "Arresting a Corrupt Lawyer/Bureaucrat"

    Yet police routinely enforce the Vehicle Code against nonbusiness automobile users.  Eighteen Sheriffs have explicitly said so.
    The reason for the mis-enforcement is that the police are relying on the ORS, which does not reflect the legislative intent that only business vehicles are to be regulated.
    The result is a sort of extortion, whereby millions of dollars are being collected wrongfully from Oregon citizens. In addition, road upkeep costs are being shifted from trucking companies onto the general public.
    This mis-enforcement can be stopped easily, if Legislative Counsel Dexter Johnson fixes the Oregon Vehicle Code to clarify that it is a business regulation applicable only to vehicles used for compensation or profit.
    Why do you suppose Dexter ignores or refuses to fix this gross misunderstanding that continues to  cost the Oregon citizens multi-billions every year?

    Restore the Republic Form of Government to Oregon

Any mismatch between the Acts and the O.R.S. constitutes a failure to have a Republic Form of Government, in which the People's representatives write the laws that are enforced.
    Make good on the promise of the Constitution: "The United States shall guarantee to every state in this union a republican form of government[.]" (Article IV, Clause 4)

    The Oregon Legislature first enacted motor vehicle laws regulating the commercial activity of transporting persons or property for compensation or profit, engaged in by "drivers for hire" in 1905.  The last time this was explicitly written was in the General Laws of Oregon, 1929. Oregon's Legislative Counsel, Dexter Johnson's has confirmed this in a document of his own writing, dated August 18, 2008.  Mr. Johnson is the single man in Oregon who is the primary source of the enactments of the Oregon Legislative Assembly.
    The statutes are explicitly written, yet a reader must know how to read the message that is conveyed.  The Oregon Revised Statutes at chapter 174 describes "Statutory Construction".  Definitions at ORS 174.100 include a list of entities, by way of defining "person", who are subject to the law.  Under Oregon's Constitution, every law is required to "embrace but one subject".  The opening lines of chapter 174 say, these definitions are to be used throughout the entire Oregon Revised Statutes, unless a particular section needs something else. The listed entities are all organized for the purpose of doing business
    Police officers routinely enforce what we now know as the Vehicle Code against nonbusiness automobile users. Eighteen Oregon Sheriffs have explicitly admitted this is true.
    Mis-application of the Vehicle Code happens because most law enforcement personnel are unable to read the law as it is intended to be read, in a meaningful manner.  Oregon's schools are blatantly in criminal violation of the law that requires them to provide courses of instruction intended to promote good citizenship. Consequently, schools routinely produce a certain percentage of graduates who are illiterate, and demonstrate anti-social proclivities.  These individuals become "model police officers". 
    On the other hand, a few individuals at the top of the food chain know exactly what is going on.  Their financial well being and potential for expnsion is specifically dependent on such mis-application of the law(s).  Not only is this going on at the law enforcement level, but the DMV and the "Traffic Courts" are involved as well.  This makes it possible for our corporate neighbors to truck goods to our store shelves from foreign sources, that can not be produced by American workers on a competitive basis. 
     As a result of the extortion just described, many millions of dollars are being unlawfully taken from "the traveling public" of Oregon.  A car owner who is regarded as a "person" subject to the Vehicle Code will pay $2,000 to $3,000 or more, per year just to get around, because of this fraud every year.  These millions of dollars are used to underwrite the corporate shippers and haulers costs of doing business and fixing the damage their commercial rigs cause to the public right of way.
    This mis-enforcement can easily be stopped by Legislative Counsel Dexter Johnson.  All he needs to do is include crucial words (conveniently omitted in today's Code) such as "driver" (one who is employed to drive); "operating motor vehicles in Oregon" (the physical operation of vehicles for business purposes); "passenger" (those who pay a fare to be transported);  "motor vehicle" (vehicles used for the transportation of persons or property for compensation or profit, just like the United States Code says) in the general definitions at the beginning of the Vehicle Code.
    A brief statement of the purpose of the Vehicle Code at its beginning needs to include, that the people's trustee of highways, DMV, in order to assure a certain quality of vehicular travel to the general public, will regulate and collect fees and taxes from the commercial operators who use them for profit and private gain.
    Consider how the extra hundreds of millions of dollars of dollars is spent each year, when next you travel along a road full of potholes.
    The USDOT is also involved in this scam.  The DMV collects the federal motor vehicle fuel tax at the pump, along with the state taxes.  Then the USDOT gives the states back a portion of what was collected in order to fund new road construction.

    Restore a Republican Form of Government to Oregon by signing the petition that would have Dexter Johnson put the important words and phrases back into the Vehicle Code.  The Oregon Constitution declares that all roads are for a public purpose, and the Vehicle Code backs that up by stating that "Highway" means every public way open to the general public for vehicles as a matter of right (see the Vehicle Code's alphabetical list of general definitions). 

    Sign our petition to stop the fraudulent mis-application of the Vehicle Code to members of the general public who use the highway as a matter of right.
