
Having kept abreast of the case of the MURDERED GERMAN SHEPHERD SERVICE DOG, in our area, and seeing the lack of enforcing the powerful ALABAMA CRUELTY TO DOGS and CATS ACT, on the part of D.A. Kirke Adams; we are asking for signatures, to institute a recall election for the position of D.A. 33rd Judicial Circuit.
This is a brief summary of the background of this case. One night when the owners of a German Shepherd Service Dog named General Fuzzy, were out of town, 4 teenage boys came on the Gales private property, and premeditatedly shot General Fuzzy, who was in his own yard, behind a 5 foot chain link fence with another fence on the outside of the chain link fence. He was double fenced! General Fuzzy, was shot twice, and ultimately died. General Fuzzy, was murdered with a shotgun loaded with buck shot.
Mr. Adams claims that General Fuzzy died instantly, and that he did not suffer, therefore General Fuzzys murder fails to fall under the ALABAMA CRUELTY TO DOGS and CATS ACT!
The owners of General Fuzzy, have investigated not only how General Fuzzy, died, but also consulted with a number of attorneys who directly dispute Mr. Adams interpretation of the law of the ALABAMA CRUELTY TO DOGS and CATS ACT OF 2001.
The owners of General Fuzzy, have also talked with several veterinarians who have stated inequitably that Mr. Adams assumption of instantaneous death is ridiculous. The past President of the Alabama Veterinary Medical Association has directly, in writing, disputed this preposterous theory of Mr. Adams!
It is obvious to us that the General Fuzzy Murder Case, ideally fits this powerful law instituted by the Legislature of Alabama. The failure to charge under the correct statue of the law in Alabama, Mr. Adams is not only protecting the criminals, but also leaving the door open for more such cruelty to animals.
It seems Mr. Adams believes he knows more about the law than anyone else does, and that he knows more about Veterinary Medicine than the doctors!!
When the D.A. fails to prosecute under the applicable law, what kind of message is that sending to others predators/criminals in Alabama? (If you do not like someone, just go shoot their beloved pet, and walk away with a slap on the wrist!)
1) D.A. Kirke Adams failed to charge the 4 killers/predators under the correct law.
2) D.A. Kirke Adams failed to charge 3 of the killers with anything at all, free walk.
3) D.A. Kirke Adams distorted the law relevant in the General Fuzzy murder case in order to exercise his own agenda. (The shooters mother is also an attorney).
4) D.A. Kirke Adams failed to seriously investigate this case, (as one attorney told the owners, dont expect much from Adams, he may be intellectually smart, but he is pure politician, and lazy. Dont expect him to do the work it would require to prosecute these criminals under the ALABAMA CRUELTY TO DOGS and CATS ACT.)
5) D.A. Kirke Adams failed to notify the victims (owners) of the first hearing in this case!
6) D.A. Kirke Adams position seems to be to protect and defend the guilty and ignore the victims!
7) D.A. Kirke Adams has opened the door to more such violent acts of cruelty and death to the domestic animals in Alabama, by his lack of care for such animals and their owners and by mis-charging the General Fuzzy case.
8) The owners told us: that in talking to several law enforcement officers, they told us that it is not unusual for Mr. Adams to plea down a case, regardless of the obviously clear law that the officer has charged the criminal under.
9) D.A. Kirke Adams told the owners of General Fuzzy that the killers would get in more trouble with the court by charging them with a misdemeanor than they would be if he charged them with a class C felony.
10) D.A. Kirke Adams told the owners of General Fuzzy that if the killers had only seriously hurt General Fuzzy instead of killing him with a shotgun, then he would have charged them with a felony under the Cruelty to Dogs and Cats act, but because the killed him he could only charge the shooter with a misdemeanor. SAY WHAT! Seriously Hurt a Dog or Cat and get charged with a felony but shoot and kill your Dog or Cat and you will only be charged with a misdemeanor.
11) D.A. Kirke Adams told the owners of General Fuzzy that the police do not know anything about the law and often charge people under the wrong section and then he has to change it. (From what we know so far, it is always changed to a lesser offence)

Many other Animal Rescue, Humane, and Animal protection groups are watching this case, and the terrible miscarriage of justice, created by the failure of D.A. Kirke Adams to initially charge the 4 teenage males under the correct Alabama statue. In actuality Mr. Adams, let three of those involved completely off, although they were initially arrested by local police. Mr. Adams also ignored the clear facts that all four were clearly guilty of being on and fishing on CLEARLY POSTED PROPERTY (not the owners), that all four were guilty of then TRESPASSING ON THE PRIVATE PROPERTY OF THE OWNERS OF General Fuzzy, and in not leaving or reporting the killing, the three others involved are in effect conspirators to the killing.
To the best as can be determined, Mr. Adams has taken a total of 17 charges against 4 individuals, 4 of the charges being felonies, and reduced it down to one misdemeanor against the shooter, whose mother is an attorney.

We will soon be circulating this petition in Dale and Geneva counties for personal and official signatures.
I have spoken to the owners of General Fuzzy and they said they are going to be working on a campaign to have Mr. Adams defeated in the next regular election if we fail with this recall petition. They are also talking about using BIG posters, flyers, mass mailings and hiring people to be outside the polling places on Election Day to remind the voters of Mr. Adams record, and using the same little signs that politicians place along the road side during campaign time.
Although this recall petition cannot be used in an official capacity, it will help in an overall effort to bring attention to the problems in getting Cruelty to Dogs and Cats Law enforced in Alabama and other states that have similar laws. It will also aid in encouraging states without these laws to enact something similar for their state.
Many people realize it is time that the states and judicial system recognize that our beloved Dogs and Cats are more than property that can easily be replaced at you local hardware store or Wal-Mart! They are our fur baby children, let us see that they are properly protected.
SPECIFIC LAW REFERENCE: Article 11of the Alabama Code, enacted in 2001, CRUELTY TO DOG OR CAT. Section 13A-11-240 Through 247. The specific charge should have been under Section 13A-11-241, a Class C Felony.
