On January 20, 2025, Trump signed an executive order to end birthright citizenship — the guarantee of US citizenship to virtually everyone born in this country. The bogus order has never gone into effect, because every federal court that has considered a challenge to it has struck it down. The case has now reached the highest court in the land, where Trump hopes the justices he personally appointed will do him an egregious and unconstitutional favor.
The 14th Amendment to the Constitution could not be more clear. Ratified in 1868, it states that "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." Those words have governed American life for more than a century and a half. They were written to be universal. They were written to be permanent. And no president has the power to rewrite them with the stroke of a sharpie.
The Trump regime is currently arguing before the Supreme Court that the 14th Amendment does not confer automatic citizenship on every baby born in the US and that it was only ever meant to cover formerly enslaved people and their children. Seriously. This is a radical, revisionist rewriting of constitutional history that has been rejected by legal scholars across the political spectrum.
