State attacks on marriage equality continue to persist. Just last week in Texas, the state Supreme Court ruled that local judges can now refuse to perform marriage ceremonies for same-sex couples – or any couple whose union they don't support – based on "sincerely held religious beliefs."
Lawmakers in the following five states introduced resolutions that explicitly call on the U.S. Supreme Court to revisit and overturn Obergefell v. Hodges, the 2015 ruling that legalized marriage equality nationwide:Idaho
Michigan
Montana
North Dakota
South Dakota
In four other states – Missouri, Oklahoma, Tennessee, and Texas – lawmakers have proposed bills that would define a new, restrictive category of "covenant marriage" exclusively for heterosexual couples. The intent of these bills is to create unequal marriage rights that could lead to a legal challenge designed to overturn Obergefell.
We've come too far. We can't let this happen.
Everyone deserves the freedom to marry the person they love. Tell your lawmakers to stand on the right side of history and protect the ruling that made marriage equality the law of the land. Sign the petition today to help ensure progress is not reversed.Subject: I Urge You to Protect Marriage Equality
Dear [Honorable/Senator/Representative] [Lawmaker's Last Name],
I am writing to you today as a concerned constituent to urge you to take decisive action to protect marriage equality for all Americans. The freedom to marry the person you love, regardless of sex, sexual orientation, or gender identity, is a fundamental freedom that is once again under threat.
Across the country, we are seeing coordinated state-level attacks intended to erode and ultimately overturn the 2015 Obergefell v. Hodges Supreme Court decision that legalized marriage equality nationwide.
In 2025 alone, lawmakers in at least five states (Idaho, Michigan, Montana, North Dakota, and South Dakota) introduced resolutions explicitly calling for the U.S. Supreme Court to overturn Obergefell. Similarly, states like Missouri, Oklahoma, Tennessee, and Texas have proposed restrictive "covenant marriage" bills designed to create a separate, unequal standard for marriage and invite legal challenges to the current law.
Most recently, a Texas Supreme Court ruling affirmed that judges in the state can refuse to perform marriage ceremonies for same-sex couples – or any couple whose union they don't support – based on "sincerely held religious beliefs." This is a clear and present regression of the progress we've made so far and a frightening reminder that these rights are not secure.
These state-level attacks make it clear that we need stronger legal protections. I urge you to use your power as my elected representative to defend marriage equality, including opposing any state-level bills, resolutions, or measures that would undermine Obergefell, create discriminatory definitions of marriage, or allow for religiously-based refusals of service.
Protecting the freedom of all Americans to marry the person they love is not a partisan issue; it is a human rights issue. I ask you to please stand on the side of equality and affirm that all families deserve dignity, recognition, and protection under the law.
Thank you for your time and consideration of this urgent matter.
Sincerely,
[Your Name]
