Caffe Buon Gusto is located in the upper east side of Manhattan and is situated in a residential neighborhood in the middle of the block of 77th Street between 2/3rd Ave.
The restaurant started using the backyard in 2017 with few birthday parties a month at first and then multiple birthday parties a day when the weather is pleasant or not raining. Then the backyard became the party room for the restaurant. During the pandemic, there were people in the backyard dining until the restaurant closes at 11:30 p.m. regardless of the weather.
The behavior of the restaurant totally disregards the residents who live in the neighborhood. We all want peace and quiet and to be able to relax in our own apartment. However, the echoing sound of 20-30 people dining in the narrow backyard space makes it impossible.
In addition, the restaurant does not have the Certificate of Occupancy or Letter of No Objection from the Department of Building to use the backyard space. The Department of Building issued ECB violations, however, the restaurant did not attend the scheduled hearing and subsequently postponed the hearing 4 times. In the meantime, the backyard dining continues.
We would like the restaurant to stop the use of the backyard space completely so that we can have peaceful quality of life in this neighborhood.
