Once again, this individual has committed more violent and heinous crimes against women and children. He has been found guilty of 10 new violent crimes. We need to let the ADA, Toff Tofflin on the case, the DA overseeing him, Natasha Irving, AND the Judge, know what WE the citizens harmed by this man want them to do. This petition is not just based on "feelings", it is based on court precedents and judgements as well. They try and say he has more charges coming to trial so that will give him a couple more years added on; Yes thefts and drugs. Well, I say SO WHAT! His beating, terrorizing, raping, & strangling WOMEN and CHILDREN are more serious, and that it's time to deal with THIS type of crime appropriately for once. It's time for our legal system to show, OUR LIVES are more important than whether or not he ripped of DHS or dealing. Our demand is that MAXIMUM sentencing be given for ALL charges, NO probation, NO waiving of time to serve, NO early parole, and all to run concurrent. As legal determinations show in State v. Hewey, "Of all Class A offenses, only the "most heinous and violent crimes committed against a person" are punishable by a maximum period of incarceration ABOVE the "original" limit." Witham meets these criteria used in determining maximums for public safety. He also meets the criteria for sentencing under ACCA 18 U.S.C. § 924(e) & (g). with a minimum of 15yrs. Also in order to meet Title 17-A sentencing guidelines, we are aware the Judge must offer a "sentencing alternative". To that we request the following: 70 yrs, no early parole. Using a ten year time frame minus his current time served the remainder up to 10 years waived, leaving 60 years to serve and of course probation offered of 5 yrs AFTER serving the full minimum of 60 for all 10 convictions. These demands are not unreasonable as the 60yr would only be equal to the 3 class A felonies maximum and the gun possession another 10 as well as the other 6 convictions which would in effect add to that time to over 70 max sentencing. As such, he is technically being granted by this, the required deferred sentence. As such as this does not exceed the maximum sentencing, it meets the Apprendi principles to ensure constitutionality. This would meet all legal sentencing statute requirements and precedents and still protect society from this menace.
