Retroactive Offender Registrations violate the United States Constitution

In 2014, Maryland Court of Appeals recently issued a ruling that retroactive application of the sex offender registration law to an individual whose crime occurred years before the law enactment violated the Maryland Constitution Declaration of Rights Article 17 prohibition against ex post facto law.

The terms of registration should be in accordance with original sentence and not pursuant to the retroactive application of the 2001, 2009 and 2010 amendments to the sex offender statute.

No Bill of Attainder or Ex Post Facto Law Shall be Passed

Department of Public Safety & Correctional Services v. Doe I, Doe II, Sanchez, and Del Pino, according to the decision, approximately one forth on the registry has the right to be removed from the list.

DPSCS begins removal of offenders from Maryland sex offender registry

The 2001 changes in law required retroactive registration. I am currently on the list and seeking support from all similarity situated individuals to be removed from the registry.
