A recent U.S. Senate investigation shows how 340B has become a profit generator for big, tax-exempt hospitals, national for-profit chain pharmacies and middlemen at the expense of patients, taxpayers and employers.

As your constituent, I urge you to prioritize comprehensive 340B reform following mounting evidence of program abuse.

A years-long investigation of the 340B program by Senate HELP Committee Chairman Dr. Bill Cassidy illuminated longstanding problems within the 340B program that require immediate legislative reform. The investigation revealed hospitals, as well as for-profit contract pharmacies and drug middlemen, exploit the program and are generating hundreds of millions in 340B revenue, marking up the cost of medicines substantially, while vulnerable patients see no benefit.

I urge you to support 340B reforms that would:

1. Require transparency on how 340B revenue is used to ensure direct savings for patients, not hospital profit margins

2. Investigate and regulate contract pharmacy and third-party administrator fees to prevent middlemen from diverting funds from patients

3. Establish clear guidelines to ensure discounts actually benefit 340B-eligible patients, including examining legislative changes to the definition of eligible patients and contract pharmacy practices

The 340B program has grown into the second-largest federal prescription drug program, and without action, the program will continue to raise costs for us all while hospitals, PBMs and big chain pharmacies pad their bottom lines.

Please prioritize comprehensive 340B reforms that bring transparency, accountability and direct patient benefit to this program. The time for action is now.
