Montana, Bring our Disabled home.

  
   If you reside in Montana, we are asking for your help with a situation which clearly needs attention from our government and awareness of  the American people. This concerns the discrimination our Federal Government has placed upon disabled Americans living abroad. The disabled who want to come home but can not afford the cost of the filing fees and required income level, which most disabled Americans can never hope to meet, are being denied the rights that other Americans have. These costs are incurred when an American citizen either marries a foreign national, or has children with foreign citizenship. These requirements come directly from the U.S. Federal Government, making it all but impossible for the disabled to return home.

    Our son, Jason, is one of these disabled people. He remained in Norway, when we returned to the U.S. after having lived there for three years.  He was undergoing medical treatment, making good progress, and did not want to start over again. He never intended on staying permanently.  
    After we left Norway, Jason met, and later married his wonderful wife Vera. They have now been married for over eleven years, and have a daughter, Victoria, age ten.  Both Jason and Victoria are American Citizens holding American passports, yet they are being denied the right to come home as an intact family. He is being punished for having to live within the means that Social Security awards the disabled.

    The families of our disabled are considered a financial risk, yet we have thousands of illegal aliens here who are draining our funds. Here is an American based family who simply wants to come home to their own country. Please help this worthy cause, by signing this petition - not just for our son and his family, but for all the other countless disabled going through this same heartache.
We must ask our Senators to uphold America's claim for equality and justice for all.
Dear Montana State Senators John Tester and Max Bacus,

We the undersigned. wish to make you aware of our dissatisfaction regarding the current laws concerning disability and immigration issues.
While the current rules of the USCIS protect the rights of disabled foreign nationals  applying for immigration, they do not show the same kindness for our disabled American citizens living abroad who wish to come home.

In truth, just as the rules are set forth for disabled immigrants seeking to enter the United States, our citizens are likewise not refused the right to live on American soil based on their disability.  They are only denied this right if they are unwilling to leave a foreign born spouse and children behind.
The standards set forth on form I-864P exceeds the financial means the average disabled citizen could ever hope to reach, and their inability to match the financial demands as set forth in section 213A, insures the denial of their family's immigration request.  
This equates to a denial of the rights of the average disabled U.S. citizen to live in his or her country.  If a person is unable to earn meaningful wages as a direct result of a disability and therefore can not reach the income requirements, or afford the filing fees set by USCIS, is this not directly penalizing and discriminating against them for being disabled?

When the rights of our disabled are protected against discrimination in matters of housing, schooling, employment, etc., to insure they have equality of life, why then are they denied this specific equality and pursuit of happiness?  A basic human need is the right to keep your immediate family intact.

It is our belief that our disabled should be exempt from these financial requirements.
We request that you take necessary steps to change this law and ask that you uphold America's claim of  equality and justice of all.
