A man was sentenced to jail 13 years ago for armed robbery, but authorities never actually put him in a Missouri prison. He's turned his life around, has a family, and is a productive member of society.
He has not committed any further crimes. The state finally realized they'd never incarcerated him, showed up at his house, and arrested him last September. Now he's supposed to spend the next 13 years in jail, while his kids grow up without him. His lawyers argue that because he went so long without being jailed, it's unfair to make him serve the full sentence so many years later. The victim of his crime, the man he robbed, agrees.

UPDATE: Missouri Attorney General Chris Koster filed to deny release of Anderson, yet set a path to Anderson's immediate parole. At this point, Anderson has served 9 months of a prison term he mistakenly didn't serve after originally sentenced 13 years ago. Strangely, in setting out the path to parole, Koster cited a previous case also involving Anderson, who was erroneously released and asked to be credited as time served during his erroneous release. If the court grants Anderson's erroneous release time, he will have served the mandatory 11.5 years and be immediately paroled by the state.
