Sedona is one of the most beautiful places on Earth, a popular tourist destination and home for those who are passionate about enjoying natural beauty and a healthy atmosphere. Over $439 million is made annually from visitors that flock here to explore wildlife, astronomy, spiritual quests and outdoor activities ranging from bicycling to hiking and camping.
Our quality of life is being SEVERELY compromised because of the continued aerial spraying of toxic chemicals and heavy metals into our troposphere, the lowest portion of the stratosphere by unmarked large jets, witnessed to be military craft or re-purposed commercial aircraft, on a DAILY basis. Our skies are no longer that deep, gorgeous blue filled with magnificent natural cloud formations that we have boasted proudly in the past but rather a hazy yellowish light blue devoid of any moisture or natural clouds. In the evening, the stars are barely visible most nights compared to as late as October 2014, and up to 90% of astronomy-based and other nighttime tours must be cancelled due to poor visibility because of the day and night onslaught of aerial spraying.
These conditions are not only costing residents who make their living from tourism-based businesses, but are actually killing off the reason that tourists visit in the first place. The air, water and soil is harmful to take in and the aluminum particulate that falls to earth is also a fire accelerate, which we cannot afford. WE AS A CITY HAVE AN OBLIGATION TO INFORM RESIDENTS AND VISITORS OF THIS HEALTH HAZARD AND DO ALL WE CAN TO STOP AND REVERSE ALL DAMAGES EXPERIENCED FROM THIS DEADLY ASSAULT FROM THE AIR.
We are unique as a state in that we actually DO have state law that prohibits the aerial spraying of toxic particulates, metals and chemicals in aerosol form from even a federal source--ARS TITLE 49-421, which states the following is PROHIBITED:
1. "Air contaminants" includes smoke, vapors, charred paper, dust, soot, grime, carbon, fumes, gases, sulfuric acid mist aerosols, aerosol droplets, odors, particulate matter, wind-borne matter, radioactive materials, or noxious chemicals, or any other material in the outdoor atmosphere.
2. "Air pollution" means the presence in the outdoor atmosphere of one or more air contaminants or combinations thereof in sufficient quantities, which either alone or in connection with other substances by reason of their concentration and duration are or tend to be injurious to human, plant or animal life, or cause damage to property, or unreasonably interfere with the comfortable enjoyment of life or property of a substantial part of a community, or obscure visibility, or which in any way degrade the quality of the ambient air below the standards established by the director.
3. "Person" includes any public or private corporation, company, partnership, firm, association or society of persons, the federal government and any of its departments or agencies, the state and any of its agencies, departments or political subdivisions, as well as a natural person.
4. "Special inspection warrant" means an order in writing issued in the name of the state of Arizona, signed by a magistrate, directed to the director or his deputies, authorizing him to enter into or upon any public or private property for the purpose of making an inspection authorized by law.
Senator Kelli Ward is also unique in that she was the FIRST and ONLY legislator the state or federal level to hold a hearing on the subject! The meeting was held on June 25, 2014 and can be viewed here: https://www.youtube.com/watch?v=IeqdFJphGT0 We wish to thank her for this pioneering effort to address this issue.
Now, we ask that our CITY AND STATE lawmakers UPHOLD and to the extent of their power enforce TITLE 49.421. Currently, the ADEQ maintains that the chemical spraying trails are simply contrails, which WILLFULLY IGNORES the fact that all modern large jets, commercial and military, are equipped with HIGH-BYPASS TURBOFAN ENGINES that are virtually INCAPABLE OF PRODUCING CONTRAILS! The only modern jets capable of producing contrails are fighter jets, and then only rarely (>90% humidity) and briefly, dissipating within seconds. Because these are SPRAYS from nozzles retrofitted onto the aircraft and NOT emissions from the actual jets, ARIZONA has the right to regulate and ban this pollution, NOT THE FAA, as the ADEQ has repeatedly stated.
PLEASE CONTACT THE ADEQ with your concerns here--and remind them of why this is NOT a matter for the FAA or EPA:
