Protect our First Amendment Right to Freedom of Religion.

Background: 

On January 20th 2012 the Obama administration issued a final rule through the Health and Human Services department mandating that sterilization options, abortifacients (abortion drugs), and contraception services must be included in health plans, including those offered by Religious charities, church-based hospitals, Religious universities and other faith based social services agencies.

 

Argument:

            Amendment 1 – Freedom of Religion, Press, Expression (Ratified 12/15/1791)

            Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, or abridging the freedom of speech, or of the press: or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

The First Amendment “permit[s] hierarchical religious organizations to establish their own rules and regulations for internal discipline and government, and to create tribunals for adjudicating disputes over these matters.”

 

Prior decisions of the US Supreme Court generally have taken the position that the Commerce Clause covers only “economic” activity and that “non-economic” activity cannot be regulated by the federal government and must be left to the individual states. Medical insurance is a non-economic activity or an inactivity not covered by the Commerce Clause. If the federal government can regulate Americans who are engaging in the non-economic activity or the inactivity of not buying Abortion paraphernalia, then one can argue that there is then nothing that the federal government cannot command Americans to do.

Dear Mr. President:

 

We the undersigned write you to express my deep concern about the Department of Health and Human Services mandate and implementation of the Affordable Care Act of 2010. More specifically the rule requiring health insurance plans to cover contraceptive services and abortion procedures. It is the belief of those who have signed this petition that this mandate violates our First Amendment right to freedom of religion, thus making it unconstitutional.

Recently Chief Justice John Roberts ruled that the first amendment “permit[s] hierarchical religious organizations to establish their own rules and regulations for internal discipline and government, and to create tribunals for adjudicating disputes over these matters.” Furthermore it is unconstitutional for the government to mandate any person or organization to purchase or participate in any entity they do not want or need.

Therefore, I call on you to rescind your administrations ruling.  The choice to use contraceptive services will still lie with individuals. However, you must take into account of the people and religious organizations that must violate their beliefs by performing these services.
