Necessary waiver for five month waiting for reciving Social Security Disability for Terminal Illness

Hello, I need help,

 I have  received notice from the Social Security Administration that I am eligible for disability benefits due to being diagnosed with a terminal illness. I was diagnosed with Small Cell Lung Cancer in September 2012 and the oncologist gave me a one in five chance of surviving for five years. I continued working through chemotherapy and radiation treatments due to the need of insurance coverage and a salary. Because I was working I was not able to apply for any disability benefits because of the rules but subsequently I battled the cancer and it went into remission for four months. The cancer has returned as predicted by my oncologist who has estimated my survival rate to be six to 12 months. I have stopped working effective March 2013 and I applied for  disability benefits which were just approved but have to wait five months. I am presently living on an accelerated life insurance policy and using accumulated leave time to pay for insurance.

I have read the letter and pamphlets concerning Social Security Disability and have concerns which I have intended this letter to address. My main concern is my five month waiting period for the disability to become active, payment made on 6th month. It is my understanding from the written information and also Social Security personnel that this five month waiting period is required in the event a persons condition should improve and does not need disability, as an example, back injury, neck injury etc.  In the cases where a doctor has diagnosed a person with a terminal illness, that person will never recover. The facts of the determination would have to be documented and irrifutableable. The doctor may give an estimate of survival rate such as six to 12 months but he or she does not clearly know. It may be three months or 21 months, I will not be one of those who's health or disability will ever improve as I am terminally ill.

I am writing this letter as an appeal in hopes there is a waiver that may be issued by the Social Security Administrator, or even the President. If not then at least start the process so the terminally ill may be able to receive the financial assistance they have paid into all these years. I for one have paid in for disability benefits for 45 years. Now I must wait the mandatory five month waiting period, payment on the sixth month,  and not leave my family in a financial disaster. Also, it would be very nice to be able to afford a final dinner with my family. That's not a pity party statement that is an earned right to go out with dignity after all these years.

 

I have tried to get help from my representatives and one aide said " Patrick Leahy is very busy but  he tries every year to get it changed and just isn't able to. I beg to differ, if a general speaks the soldier jumps. Leahy has some heavy duty rank.  I am a little skeptical when I hear that and he is suppose to be the 3rd in line for the presidency. My other representative Bernie Sanders said basically  that's to bad and "trees, we need more trees." And my third, Congressman Peter Welch said he's sorry to hear about that, there's nothing he can do and maybe "you should contact the American Cancer Society", excuse me I have to cut a ribbon and don't forget to vote in November


 

 

Senators and Congressman, I don't believe I am asking for what is not mine. I have worked since I was six years old on a dairy farm owned and run by my father. I have worked in various jobs with the longest being 23 years in Law Enforcement, reaching the rank of Lieutenant Detective.


 

I would like to give the everyone including Senators and Congressman an update on my condition, today is May 8, 2013, I just let my ongologist office. He has told me I will probably not live till Winter. How do my bills get paid, how about medicine, how about being able to do something as a family before I die. I will die without receiving one penny from what I paid in for over 45 years.  

 

Senators and Congressman, I'm just asking if you would take a look into a waiver or whatever you can do to help, that's why we elected you, TO HELP !. I'm only going to live until winter and I don't think it will affect the deficeit if I was to receive my Social Security that I have paid in from the time I had to pay taxes.  I like to thank the aide that read this,I do understand your boss must be a very busy person taking care of the citizens of the world and forgeting about us Americans who elected you.
