
This petition is a citizens complaint to request the US EPA bring forth to the DOJ our allegations to investigate and charge Kirkland Air Force Base (KAFB) and the New Mexico Environment Department (NMED), for "knowing endangerment" under the statutes of RCRA, CWA, SDWA and CAA; the statutes were violated and egregious environmental crimes committed; that both of these entities have waited 10 years, before a perfunctory mitigation was started with KAFB erroneously putting in the monitoring well that gave unreliable information. In 2010, the data is still unreliable.
There has not been an Environmental Impact Study (EIS) of the problem, which violates NEPA. The current mitigation techniques done without public comment or study will disperse contaminant throughout the aquifer; are poisonous to a large portion of the population that cause cancer and other endocrine disrupting effects to human and environmental health.
The US Federal Prosecutor should be called to demonstrate that the defendant(s) were aware of the leaks and spills for than 10 years, the Kirtland Air Force Base was knowingly a repetitive offender and that KAFB had been given mandatory deadlines, which they ignored before they received a consent order from NMED in 2008.
KAFB should be held liable for their egregious crimes against the people that 25 years of mitigation will not be able to clean and which is permanently damages the aquifer.

KAFB should be slapped with an injunction order to halt further development until this matter is investigated and crimes against nature and humanity have been resolved.
We, further insist that this project and investigation mitigate issues of Environmental Justice. President Clinton Executive Order 12898 specifically states:
"...each Federal Agency shall make achieving environmental justice part of its mission by identifying and addressing, as appropriate, disproportionately high and adverse human health or environmental effects of its programs, policies and minority populations and low-income populations...."
New Mexico includes some of the poorest counties in the nation and are primarily composed of Hispanic and Native American populations and low-income residents.
