To Marshan Township officials (Marjory Snyder, Jerry Bauer, Jim Wollmering, Joe Birk, John Maher, George May, and Ron Wasmund):

Each person signed below is concerned for the dogs in the care of B. Tracy and Braveheart Rescue, Inc. The plan presented to you on June 2, 2012, is what is in the best interest of the dogs. We are asking the board to approve and implement that plan to give the remaining dogs at Braveheart Rescue, Inc. the best chance possible at a full and loving life. Being placed in new homes without rehabilitation puts both the dogs and future owners at great risk. To defiantly close the shelter and seize the dogs is an unjustified death sentence.

Your planned closure of Braveheart Rescue, Inc. is set for July 17th. It appears Ms. Tracy is not complying with your order as she has a fundraiser scheduled 2 days before the closure date. We ask that you not allow her defiance to cloud your judgment and compassion. We ask that you act on behalf of those dogs at that shelter and implement the proposed plan.

It is our sincere hope as human beings that the board will step outside of their personal feelings towards the people and past events concerning B.Tracy and Braveheart Rescue, Inc. to do what is morally right for the dogs.

Dissolution Plan For Braveheart Rescue, Inc.

Summary:

This plan is to take effect upon its formal issuance by the Marshan Township Board, County of Dakota, State of Minnesota. It will run in effect for one year from the date of issuance.

This plan is to provide the necessary care for the rescued dogs currently at the shelter known as Braveheart Rescue, Inc. (hereafter called The Shelter) in Marshan Township. The time is deemed sufficient to provide rehabilitative care for all the dogs currently at The Shelter. The owner and proprietor, Brandi Tracy, is solely responsible for the implementation and follow-through of this plan. All other officers and managers of The Shelter are compelled to assist in the execution of this plan.

Upon acceptance of this plan by The Shelter, this plan will be binding on The Shelter only. If this plan is not accepted or is deviated from then the initial action to close The Shelter and seize the dogs on the property will be recommenced immediately.

Licensing:

Under Minnesota Statute 347.31 (subd. 2) Braveheart Rescue, Inc. has been determined to be a shelter, not a rescue group. Accordingly, The Shelter is not exempt from the statute. Therefore, Ms. Tracy or her designated agent will obtain the required $15 shelter license from the Minnesota Board of Animal Health. Contact for the license = 651-201-6808.

Inventory:

Immediately upon acceptance of the plan, The Shelter is to provide the Town Board with a full and complete inventory of all dogs on the property and under the control of The Shelter. This is to exclude any personal companion animals on the property. This inventory will list each dog to include a name or ID number as well as a general description of size and coloring. It is expressly forbidden for The Shelter to take in or add to inventory any additional dogs for any reason other than rehomed dogs returned to the shelter. The current population is the beginning count for the purposes of this plan.

Disposition:

The Shelter will immediately provide a complete behavior analysis of every dog as soon as this plan is accepted and implemented. This analysis is to include a behavior profile of challenges needing rehabilitation, a course of action to correct existing problems, and an estimated time frame for completion of each dog's rehabilitation.

Rehabilitation Program:

Each dog will have a formal rehabilitation/training program outlined. This program will be adhered to with weekly updates on each dog submitted by The Shelter for review and approval by the Town Board. These reports must be accompanied by photos or videos of Ms. Tracy working hands-on with the dogs in her care. This is not work which falls under the category of kennelling. All proper feeding and care routines are to be maintained. Outside rehabilitation or training assistance may be obtained as needed but must be volunteer or nominal in cost. A protocol for reporting will be established mutually once the plan is accepted and implemented.

Fundraising:

Fundraising may continue but donations are to be applied directly to the care of the dogs. Only minor equipment used in the care or rehabilitation of the dogs may be replaced or repaired. Any machine such as a washer or dryer essential to providing standard kennel or rehab care may be repaired or replaced as needed. No further computer equipment, vehicles or capital equipment may be purchased or replaced. Medical costs are, of course, excluded from these limitations. All revenue and expenses are to be reported monthly to the Town Board for review. Funds sufficient to cover the typical costs of operation (e.g. utilities, food, training treats, etc) are permitted. No donations are to be used for any personal use.

Placements:

The purpose of this additional time granted to The Shelter is for the expressed purpose of providing the rehabilitation needed to ensure quality placements of the dogs at The Shelter. When the dogs have been placed The Shelter will cease all operation. It is the Town Board's hope that the management and officers of The Shelter will implement and conduct this plan in good faith.
